R. will convey ¾ of the land to her surviving issue, if any & the remaining ¼ to my granddaughter Mary Ann Ashby. To my son John J. R. That the said Joseph Powell was seized of a messuage of land as of fee, and being so seized by his certain deed dated 21 Nov. 1805, sold to Elishe Garrett, the ancestor of the plaintiffs, William R. Taylor & Bridget, his wife, & Susan Garrett, who are of full age, and Nancy, Samuel, Charles, Elisha & Sally Garrett (Sally Garrett their next friend), heirs of Elisha Garrett; that the said Elisha Garrett often required the said Joseph Powell that he would warrant to him, the said Elisha Garrett, the messuage, which he has ever since refused to do &c.3 
Land cause16 July 1812He was named in a land cause on 16 July 1812 at near Pocomoke, Accomack Co, VA. Dennis Kelly, by Thomas M. Bayly, his attorney, sued out of the Clerk's Office of the Court of this County his summons in partition against Sally Bayne & Betsy Bayne & William R. Taylor and Bridget his wife, in right of said wife, Southy Bull & Susanna his wife, in right of said wife, Nancy Garrett, Elisha Garrett, Charles Garrett, Samuel Garrett & Sally Garrett, heirs of Elisha Garrett, dec., who together and undivided hold a tract of land in the County of Accomack, containing 175 acres, to make partition thereof &c. One moiety or one half thereof and 1/4 of one moiety doth belong to the said plaintiff, and 3/4 of the other moiety doth belong to the said defendants; that the said defendants do not permit division, although the said Dennis Kelly is entitled to one moiety & 1/4 of one moiety of the said lands by virtue of a decree of Accomack County Court 2 Apr. 1812 wherein John Custis & William Robinson Custis were plaintiffs & William Nock & Agnes Nock & Lucretia Nock, children and heirs of Elizabeth Nock, were defendants, the said land being sold according to the said decree, & the said Dennis Kelly being the purchaser of the said land being recovered by the said William Nock & Elizabeth his wife against Joseph Powell in the District Court of Accomack & Northampton on the 17 Oct. 1808; Sally Bayne appointed guardian to the infant defendant Betsy Bayne, & John Bull guardian to the other infant defendants for the purpose of defending this suit.
Surveyors report: 14 Jan. 1813 - A certain tract of land containing 173 3/4 acres situate near Pocomoke in the county aforesaid, heretofore belonging to Joseph Powell & by him sold to Walter Bayne, Esq., & Elisha Garrett, both now dec., and from whom, or their heirs, William Nock & Elizabeth his wife afterwards recovered 1/2 & 1/4 of 1/2 in an undivided state, which interest of the said William Nock & Elizabeth his wife in the said lands they afterwards mortgaged to John Custis & William R. Custis, who afterwards obtained a decree of foreclosure & sale thereon, at the sale of which Dennis Kelly became the purchaser, &c.1

Land cause*28 January 1823She was named in a land cause on 28 January 1823 at Assawoman, Accomack Co, VA. That a certain Caty Nock late of this county departed this life in the month of October, 1810, seized in her own right in fee simple of a tract of land situate in this county containing 53 acres: and one other tract of land containing 16 acres, also the moiety of a mill stream and mill seat at the head of Assawoman; that the said Caty Nock at the time of her death left seven children, viz: your oratrixes Tabitha, now the wife of Robert Broadwater(sic), Mary, Elizabeth, Thomas, Joseph, Caty and Charles Nock, to whom the said land descended subject to the right of Benjamin Nock, her husband, as tenant by the curtesy; that the said Benjamin Nock departed this life in the year 1811; that the said Caty Nock & Charles Nock both departed this life in the year 1811 under age, intestate and without issue, so that the two tracts of land became subject to partition between the five remaining children of the said Caty Nock; that on the 31 Jan. 1817, the said Thomas Nock conveyed his interest in said tracts to your orator Robert P. Broadwater, &c. (NOTE: The original land cause does not show Tabitha as the now wife of Robert Broadwater.)2
