Gunter & John J. Laws these survivors & successors in trust for the purposes herein after expressed ½ acre of land where the Baptist meeting house called Zoar now stands on the sea side road to be bounded on said road the length of one acre & to run back to the eastward the depth of half an acre to be held by them in trust for the exclusive use of the members of the Baptist Church or society or that portion thereof who usually worship in said house provided that if said building shall not be used by the Baptist society for the space of 2 years at any time as a house of worship the land shall go to the person who shall then be the owner of the land attached or adjoining & on which I now reside. It is my will that the aforesaid trustees or a majority of them or the survivors or successors of them in like manner shall fill all vacancies which may be occasioned by death or resignations so that four persons be continued perpetually as trustees of said lot for the purpose aforesaid & appointments to fill vacancies be returned & recorded in the Clerk's Office. To son Benjamin T. Gunter all my lands lying on the east side of the sea side road whereon I now reside, provided that if he dies without issue the lands shall go to my daughter Elizabeth Sarah Gunter & should she die without issue, then to go as the law directs. The owner of this land shall pay to the ministers of Pungoteague Baptist for the time being $15 annually to such minister whose religious tenets are in accordance with those of that portion of the Baptist Church to which I belong (viz) to William Laws & his successors of the same tenets & faith. To my daughter Elizabeth Sarah Gunter all the residue of my lands being the land I purchased of Jesse Elliott, Zorobabel Edwards, Sabra Waples & others, but if she dies without issue, then to my son Benjamin T. Gunter & if he dies without issue, then as the law directs. To son Benjamin T. Gunter $1,000. My Negro slaves to be divided agreeably between my children after assigning dower therein to my wife but with the express condition that if at any time either of said slaves or their increase shall be sold or carried off the Eastern Shore of Virginia for no cause of disobedience, they shall have a positive & qualified right to his or her freedom & I hereby declare such slave to be free at the moment such slave shall be sold or carried off the Eastern Shore of Virginia. This mantel was made by me in my 46th year, W.H. White; Wm. Mears, Bricklayer: Henry J. Carmine, Plasterer. (NOTE: John W. White the apprentic was the son of Wm. H. White, the boss.)2

Custis, was the executor; that in order to secure the same the said Matthias Outten on the 7 Apr. 1821 conveyed to your orator a tract of land containing 40 acres and also two lots in the town of Drummond, containing by estimation 1 acre; that on the 17 Mar. 1824, the said Matthias Outten became indebted to your oratorm and in order to secure the same conveyed to your orator a tract of land near Drummondtown containing 50 acres, also one other tract of land situate near Drummondtown containing 34 acres, one other tract near Drummondtown containing 22 acres, also one lot of land in Drummondtown containing by estimation 2 acres; that on the 17 July 1824, the said Matthias Outten duly made and published his last will and testament which said will was proved 25 Oct. 1824, in which he devised to his daughter Sally T. Coleburn, wife of James H. Coleburn, for life, with remainder to his grandaughter Betsy F. Coleburn, his plantation called Snead's & Hargis, containing 40 acres, with a contingent limitation to William D. Outten & John H. Copes & Elizabeth Copes; the said Mathias Outten devised to his grandchildren John H. and Elizabeth Copes his two lots in the town of Drummond, and also devised to his son William D. Outten his field called the Joynes field, also the houses and lots on which the testator lived containing 1 acre; he also directed that the lands purchased by him from William R. Bunting, and also the 16 acres purchased by him from Mckeel Bonwell should be sold for the payment of his debts, and also gave his executor the right to sell the field called the Monger field if necessary for the same purpose, and appointed your orator and the said William D. Outten executors. The land devised by the said Matthias to his daughter Sally T. Coleburn, is the same land mentioned by the said Matthias in the second deed above mentioned to your orator, and expressed therein as containing 50 acres; the lots devised to his grandchildren John H. and Elizabeth Copes in the said will are the same lands conveyed by the first deed of mortgage to your orator; the land devised to the said William D. Outten is the same lot conveyed by the second deed to your orator; the land devised to the said William D. Outten called the Joynes field is the same conveyed in the second mortgage to your orator; the land directed to be sold and purchased by the testator from William R. Bunting is the same land conveyed in the first deed of mortgage; the land directed to be sold called the Monger field, is the same land conveyed in the second deed of mortgage containing 20 acres; the land directed to be sold purchased from Mckeel Bonwell was conveyed in neither of the aforesaid deeds; after the death of the said Matthias Outten your orator ascertained that the testator was indebted to a certain John B. Walker, his late ward, in a greater sum than the value of the whole real estate, and that there is still a considerable balance due the said Walker &c.5
