Land deed named in*1767Judge John (of Parker & Mary Watts) Selby was named in a deed in 1767 at tract A162, Jolly's Neck, Accomack Co, VA. In 1717 John Baily left the 500 acres on Euwamus Creek to his grandson Parker Selby, who was the son of his daughter Tabitha and her first husband Parker Selby, but at the time of the will, she was the wife of John Purnell of Somerset. 1767 James Selby deeded his interest to his brother William, stating that the land had been left by Parker Selby of Worcester to his sons James, John and William, and that John had previously sold his interest to James and William by a General Court deed. 1770 William Selby sold the southern 200 acres to Samuel Wilson, to become the second piece of woodland for A161 as told in that story. As also reported, in 1792 Selby bought the north 46 acres of A161 along the creek west of Selby's Bridge, and as will be reported later, he bought additional land to the eastward of him, and in 1821 he left the whole plantation to his nephew William Selby Tunnell. Selby's wife Sally later married a John Custis. In 1831 643 acres were divided among the heirs of W.S. Tunnell: this piece included at the east end a mill, which first had been called Selby's Mill and later Tunnell's Mill.4

Arthur Parks wrote his will on 30 Aug 1743 when he was "in reasonable health" and devised Hogneck, "Lying upon Dogwood Ridge Creek," to my youngest son," Job Parks. As late as 1753 Job was listed in his father' househould and probably cared for him until his death in 1760. Thomas Tyler and John Evans were sureties for a testamentary bond for £150 sterling filed by Job Parks on 8 Feb 1760. John "Evins" (Jr.), Thomas Evans, Sollomon "Evins," and Thomas Tyler, all Smith Island residents, were witnesses to Arthur Parks' will (A Somerset Sampler, p. 207). Dryden shows that Arthur Parks Sr. gave to youngest son Job, manor and tract Hog Neck on Smith Island, being 75 acres, being part of a tract on Dogwood Ridge Creek containing 150 acres. Witt: John Evans, Thomas Tylor, Thomas Evans, John Evans Jr. & Solomon Evans.4,5

(f p. 9) The deposition of Comfort Russell aged about seventy years who states that she is the widow of Robert Russell who was a Revolutionary pensioner late of Accomack County & that the paper attached hereto is the only family record of the ages of her children = that she has no record of her marriage whatever, & that belief or paper aforesaid was torn from the family Bible of her husband & the same was written by a man named John Hughes who is not now a resident of the County but resides in parts to this deponent unknown & was done according to this deponent's directions about twenty years ago or more & that the person at the top of the list named Leshea is now the wife of James Gootee (called Alesha Gootee in her son Thomas's deposition) & she was her first child & Thomas was her second child, and it appears Lisha or Alesha was born in 17 February 1792 & Thomas in October 1794 & she knows that those entries were correctly made when done as aforesaid – in the Bible from which the said leave was torn has always been in this deponent's possession = this deponent states that she was lawfully married to said Robert Russell & is now his widow. S/ Comfort Russell, X her mark.2

State of Virginia, Accomack County SS - On this 28th day of August 1833 personally appeared before the Court of Accomack County Robert Russell a native born Citizen and resident of Half Moon Island in the County of Accomack and State of Virginia, aged Seventy-six years who being first duly sworn according to law doth on his oath make the following declaration in order to obtain the benefit of the provision made by the Act of Congress passed June 7th 1832 that he enlisted in the Army of the United States in the year 1776 in Captain Thomas Snead's Company of infantry and moved in the ninth Regiment from Virginia under the following named officers, Thomas Fleming Colonel of the Regiment, the officers of the Company that he enlisted in were Thomas Snead Captain, Arthur Teackle Lieutenant and William B Bunting Ensign, the Captains of the Regiment where they marched from Virginia John Cropper, George Gilchrist, Thomas Snead, Smith Snead, Levin Joynes, John Blair, Captain Davis & John Poulson, Captain Walker, Lieutenants were Thomas Custis, George Oldham, Reuben Joynes, James Drummond, Nathaniel Wilkins & Samuel Waples & Thomas Parker & that at the time he left the service George Mathews was Colonel of the Regiment, Thomas Snead, George Gilchrist, John Cropper, Levin Joynes and John Poulson were Majors in the regular Army and George Morris was Captain, Thomas Martin was Lieutenant and Charles Stockley was Ensign. That he was a native of Virginia born in Accomack County and in the parish of Accomack where he enlisted and was eighteen years old when he enlisted and has resided in the said County ever since he left the service. That when he marched from Accomack he marched through part of the State of Maryland, part of the State of Delaware, & part of Pennsylvania to Philadelphia, then marched from Philadelphia and joined the Army under his Excellency General Washington commander in chief – he was at Trenton (February 26, 1776), Princeton (January 3, 1777) in the Jersey, that he was at the battle of Brandywine (September 11, 1777), Chestnut Hill, Iron Hill, and at the battle of German Town (Germantown, October 4, 1777) where he was severely wounded in the groin, and was taken a prisoner and was put in the new Jail in Philadelphia and from which place he was put on board a prison ship & taken to New York where he was kept until he was exchanged when he again went & joined the Brigade commanded by General Muhlenberg (Peter Muhlenberg), and that he continued in service between 4 & 5 years when he was honorable (honorably) discharged, that he has not the discharge, it has been mislaid or lost – it was signed by General Muhlenberg. He hereby relinquishes every claim whatever to a pension or annuity except the present, and he declares that his name is not on the pension roll of any Agency of any State. S/ Robert Russell, X his mark - And the Court do declare their opinion that the Applicant was a Revolutionary Soldier & served as he states – It was also proved in open Court by William R Custis (who is a son of Thomas Custis deceased who was an officer in the Virginia Continental Line in the Revolutionary War) that he has known this said Robert Russell four fifty years, and he has always understood & believed that he was a Revolutionary Soldier & served as he states. It was also proved by Levin S. Joynes & Thos. R. Joynes (who are sons of Colonel Levin Joynes deceased who was an officer in the Virginia Continental Line in the Revolutionary War) that they have known the said Robert Russell for more than twenty years & they have always understood & believed that the said Robert Russell was a Revolutionary Soldier & served as he states. It was also proved in open court by Thomas M. Bayly that he has been many years a neighbor to said Robert Russell & he has been acquainted with said Robert Russell from his (Bayly's) boyhood & he has always understood that the said Robert Russell was a Revolutionary Soldier & served as he states – and the Court certify that the said William R Custis, Levin S. Joynes, Thos. R. Joynes, & Thos. M. Bayly are credible persons, That said William R Custis, & Levin S. Joynes are Justices of the Peace &, Thos. R. Joynes is Clerk of this Court. Will*2 September 1836Robert made a will on 2 September 1836 at Accomack Co, VA. To son William Russell 100 acres to be laid off out of the 150 acres which by deed of 8 Jan 1824 I gave to my son John Russell which I have since inherited from him, he having since died unmarried & without issue & intestate. The 100 acres to be laid off so as to include the settlement where William Justice now lives & to be bounded by the branch adjoining Major Mason on the east, by the county road between it & Polly Stran's land on the southeast & by the lands of John Parks on the north. To son William Russell the land called Hickory Patch adjoining my lands next to Arthur Barnes & divided from them by a cut called Hickory Patch Gut, containing 10 or 12 acres of high land & 20 acres of marsh. To son Robert Russell the plantation where Isaiah Johnson lives & after his death to my children Littia, Betsey, Sarah & William. The land where Robert Russell Jr. now lives to him, my son Robert & his wife during their joint lives & the life of the survivor & then to my children Littia, Betsey, Sarah & William. All my other land to my 3 daughters Littia, Betsey & Sarah. Personal estate to my 3 daughters Littia, Betsey & Sarah & my son William. Son William Extr. Witt: Henry A. Wise, John B. Ailworth, James J. Ailworth. His will was proved on 29 May 1837 with Thomas Lewis (of Spencer) & John Lewis (of Daniel) securities on the $10,000 bond.2

Will*9 December 1895Parker made a will on 9 December 1895 at Accomack Co, VA. In his will Parker W. Parkes directed as follows: FIRST. I give and devise to my son George P. Parkes, all that tract or parcel of and known as the "Seth Powell land" belonging to me at this time, except one eighth (1/8) of an acre which I reserve, which includes the grave yard at the house. I also give and devise to said George P. Parkes the sum of one thousand dollars ($1,000.00) also my wheel chair. SECOND. I give and devise unto my son Edward T. Parkes, the house and lot at Parksley where said E.T. Parkes now resides. I also give said Edward T. Parkes the sum of two thousand dollars ($2,000.00) THIRD. I give and devise unto my daughter Margaret S. Causey, the three houses and lots situated in the Village of Lee Mont, and lying between the residence of Mr. A.J. McCready. I also give and devise unto the said Margaret S. Causey the sum of twelve hundred dollars ($1200.00) FOURTH. I give and devise unto my son Sylvanius W. Parkes, all that part of the Blackstone farm lying east of the Rail Road. FIFTH. I give and devise unto my son George P. Parkes, the tract or parcel of land where I now reside known as the Long field. Also the house and lot I purchased of Louis F. Hinman. Also the house and lot I purchased of Allie T. White. Also all the remainder (after payment of all my just debts and burial charges of my estate real, personal and mixed of every description, to be held by him in trust as hereafter set fourth, but the income arising from the said property shall go to the said George P. Parkes, provided that said George P. Parkes, keeps and comfortably cares for my daughter Mary A. Parkes and her lawful issue and in case it becomes necessary, or the income from said property, is not sufficient to keep my said daughter Mary A. Parkes, comfortably, then the said George P. Parkes may use so much of the personal property so held by him in trust, as may be necessary to accomplish that purpose, but in case of the refusal, or inability of said George P. Parkes, to carry out the trust imposed by this instrument, then the said Mary A. Parkes, shall have the privilege of selecting some person to execute said trust, and such selected person, shall hold the above named property, in trust for the purposes and under the conditions, herein set forth. In case the said Mary A. Parkes shall depart this life without leaving lawful issue, the I desire that my son Edward T. Parkes shall have the house and lot that I bought of Louis F. Hinman forever, and that my son George P. Parkes, shall have the house and lot that I bought of Allie T. White and that my daughter Margaret S. Causey shall have the house and land where I now reside, known as the Long Field, forever, and also all other property held in trust by the said George P. Parkes by me given for the benefit of said Mary A. Parkes, shall be equally divided between my three sons viz. George P. Parkes, Sylvanius W. Parkes and Edward T. Parkes. Lastly, I hereby nominate and appoint George P. Parkes and Edward T. Parkes, the executors of this my last will and testament. In witness whereof I have hereunto set my hand and affixed my seal this 9th day of December A.D. 1895. Signed: Parker W. Parks. Witnessed: William T. Parkes and Andrew J. McCready, who in the presence of each other witnessed the signing of the above writing. At a court held for the Courty of Accomack on the 30th day of May 1898, This last will and testament of Parker W. Parkes, deceased, was proved by the oath of Andrew J. McCready, a witness thereto, who made oath that the said Parker W. Parks in the presence of William T. Parkes another subscribing witness thereto, who being present at the same time subscribed the said will in the presence of the said testator; whereupon the said will is order to the recorded. And thereupon, George P. Parkes, one the executors in the said will named appeared in Court and relinquished his right to qualify. And thereupon on the motion of Edward T. Parkes, the remaining Executor in the said will named, taking oath and giving bond according to law in the penalty of twelve thousand dollars ($12,000.00), with Joseph Moore, George P. Parkes and Sylvanius W. Parkes sureties therein, who justified their sufficiency on oath. Certificate is granted him for obtaining a probate of the said will in due form. And the said bond having been acknowledged by the several obligors therein, it is ordered that the same be recorded. Test: M. Oldham Jr., C.A.C. (Clerk of Accomack Court.)7
