Custis' list. In 1691 he had 4 tithes on Capt. Wm. Custis' list. In 1692 he was not shown, but a Geo. Marriner with 1 tith was shown on Mr. Burton's list. (NOTE: Capt. Wm. Custis and Mr. Burton precincts were on the Sea Side in the Locustville area. Since the tithable list was continued until 1695 and he did not appear after 1691, he evidently died between 1691 & 1692.).6 He released his rights in land in 1678 at tract A125, Bloxom-Guilford, Acc Co, VA. It was in this year that Henry Sadbury sold the eastern 115 acres of tract A125 to Thomas Besant and Richard and Mary Marriner released to Besant any right they might have in the land.4 On 16 Mar 1682/83 Charles Holden, attorney for Richard Marriner, confessed a judgment of 578 lbs tobacco due to Col. Daniel Jenifer. Ordered that Marriner pay the debt and court costs. Richard Marriner assigned power of attorney to Charles Holden to confess the above order. Signed 14 March 1682/83, by Richard (R) Marriner. Witnesses: John Barnes and Peter Wells.7 On 2 Jan 1683/84 in the suit of Richard Marriner against Dormt. Sullivant (attorney: Mr. Tankred) for defamation, Tankred pleaded that Marriner had misplaced his action by not mentioning his wife, against whom the defamatory words were spoken. The court ordered that the suit be dismissed with Marriner paying court costs.8 On 2 Jan 1863/84 Henry Williams, Richard Marriner and John Wouldhouse petitioned that they had been summoned as witnesses by James Foster in his suit against Robt. Holliday; they had both attended for two days. Ordered that Foster pay them for their time and court costs.9 On 4 Feb 1685/86 Mr. George Nicholas Hack entered action against Richard Marriner for 339 lbs tobacco, but Marriner failed to appear. An attachment was granted against Marriner's estate.10 On 16 Mar 1686/87 Edmund Allen sued Richard Marriner for 324 lbs tobacco, but Marriner failed to appear. If he did not appear at the next court the sheriff would have to pay the amount awarded to Allen by the court.11 On 19 Jul 1687 the suit of Richard Marriner against Capt. Henry Custis was dismissed with Marriner paying court costs.12 On 17 Jan 1687/88 he was shown as Richard Marriner when his name appeared on a list of 9 men who were to answer for their contempt in not following Thomas Bagwell, the survey of the highway, order to mend the old bridge over the marsh at Little Matomkin.13 On 20 Dec 1688 Col. John West had sued Richard Johnson, and at the last court an order was passed against Richard Marriner, who was to assure Johnson's appearance at this court. Since he failed to appear, West craved judgment against Marriner for the 2500 logs owed him by Johnson. Ordered that Marriner pay the debt and court costs.14 On 20 Feb 1688/89 Col. John West had sued Richard Johnson, and at the last court an order was passed against Richard Marriner, who was to assure Johnson's appearance at this court. Since he failed to appear, West craved judgment against Marriner for the 2500 logs owed him by Johnson. Ordered that Marriner pay the debt and court costs.15 Richard was named in his brother-in-law's will on 15 November 1689 at Accomack Co, VA. Henry Williams left all his land to his son John, excepting land rented to Richard Marriner. It was evidently his wife Mary Marriner who presented the will. He also left cattle to Elizabeth, Richard Jr., William and Thomas Marriner, who were evidently their children.16 He died between 1691 and 1692 at Accomack Co, VA. Since the tithable list was continued until 1695 and he did not appear after 1691, he evidently died between 1691 & 1692. On 20 Sep 1693 his widow Mary Marriner was shown as a married woman (having married John Prittiman) and thus could not be sued by Henry Allin.17,18 On 19 Feb 1690/91 Edward Wright sued Richard Marriner, whom the sheriff could not find. Wright petitioned that Marriner owed him 1300 lbs tobacco and a pair of French fall shoes (boots with high drooping tops). Attachment was granted against Marriner's estate for the debt and the costs of the suit.19 On 16 Dec 1691 the suit of Lt. Col. John West against Richard Marriner was referred to the next court.
