They owed Dunn four pounds 18 shillings; ordered that attachment be granted against their estates for the debt and court costs. On 26 Nov 1688 Thomas Dunn had obtained attachment of 4 pounds 18 shillings against the estate of John Lackie, William Wallis and Thomas Crawford. The sheriff was to attach the sum in the hands of Maj. Charles Scarburgh, who [the estate] was in his hands. Ordered that attachment be continued against the estate of Lackie, Wallis and Crawford and that Scarburgh be summoned to the next court to make oath. On 19 Dec 1688 Thomas Dunn had procured an attachment of 40 pounds 18 shilllings against the estate of John Lackie, William Wallis and Thomas Crawford. The sum was to be attached upon goods in the hands of Maj. Charles Scarburgh, who denied having any of the estate in his possession. Scarburgh was ordered to appear and make oath, but since Scarburgh was not well, he sent a letter to court and declared that he was ready to testify that he had nothing belonging to the above persons. When Charles Holden, attorney for Dunn, pleaded that Scarburgh should be present, the court ordered that the attachment stand good and be continued to the next court when Scarburgh would appear to make oath. On 19 Mar 1688/89 Thomas Dunn procured an attachment of 4 pounds 18 shillings against the estate of John Lackie, William Wallis and Thomas Crawford, returnable at the November court. Under the directions of Dunn's attorney, the sum was attached on the estate in the hands of Maj. Charles Scarburgh, who denied having any of the estate. Scarburgh was ordered to appear to swear he had none of the estate, but by a letter directed to the court he claimed he was not well and was disabled, but was ready to testify that he nothing belonging to the abovementioned persons. Dunn's attorney, Charles Holden, pleaded that Scarburgh should be present, and the case was continued to the next court. Now Scarburgh appeared in obedience to the summons and "laid hold of his Majesty's gracious indulgence granted to tender consciences that he could not be compelled to swear, but did declare he had no effects of the aforesaid persons in his hands." He said he could make oath to it if enjoined. At the request of the Dunn's attorney, the court ordered that the statement be put on record.13

It was on this date that Roger Mikeel, who married the widow of James Bonwell, pay Mr. Deverax Browne 1700 lbs tobacco and court charges. According to Whitelaw, they were know to have been married by 1668, but in 1680 Rodger and Mary Mikell recorded an agreement to separate as man and wife, although later she had to sign a deed with him as his legal wife.2,3 Roger Michael (Mikell) patented land in 1673 at Onley- Onancock, Acc Co, VA. It was in this year that a patent was issued to Roger Michaell for the whole 1,500 acres, which went by the old Indian name of Ramagstuck. No record was found to reveal any relationship between this man and the two contemporary John Michaels: John Sr. of N32 and John Jr. of A70. By 1668 Roger is know to have married Mary, the widow of James Bonwell, but in 1680 Rodger and Mary Mikell recorded an agreement to separate as man and wife, although later she had to sign a deed with him as his legal wife. There are several records to show that Roger was many times in trouble with the court, and in 1685 he was spoken of as "one Roger Micheele a Knowne Pyrate and Robber."2 He was on the list of tithables at Accomack Co, VA, in 1674.      Capt. James Floyd Snr was born circa 1763 at Accomack Co, VA. That Capt. James Floyd is the son of Maj. John (197) Floyd III is based on the assumption that in 1789 when he bought part of tract N37 from John & Elishe Floyd of Princess Ann County, that they were brothers, and that this part of tract N37 descended down the chain of John Floyds from John Floyd I to John Floyd the IV, who in turn sold it to his brother Capt. James Floyd. Otherwise he may be the son of the Matthew Floyd who died by 14 Apr 1801 when administration on his estate was granted to a James Floyd.2 He married Catherine (495) Kellam, daughter of Abel or Caleb or Laban (180) Kellam and (d/o_Bartholomew) Mears, on 23 December 1785 at Accomack Co, VA. Charles Richardson was the security on the M.L.B. of James Floyd and Catherine Kellam. (NOTE: There was only one Catherine Kellam found during this period in Accomack County wills and orphan accounts, so she had to have been the daughter of Babel, alias Laben Kellam, and the paternal granddaughter of West Kellam and the maternal granddaughter Bartholomew Mears.).1 Capt. If my daughters Nancy Nottingham and Catherine Biggs wish to keep the Negroes Leah and Allice which I lent them it is my will they should do on condition they will pay into my estate the amount that the said Negroes shall be appraised at. I leave my lands to be sold by my executor. After my debts are paid I desire that the remainder of my estate be equally divided between my sons William Floyd, Jno Floyd, James Floyd, Berry Floyd and my daughters Nancy Nottingham and Catherine Biggs. I appoint my son William Floyd guardian to my son Berry Floyd. I appoint my sons William Floyd & Jno Floyd my executors. Signed, James Floyd. Witnesses: Jno K.
