(Mikell?), daughter of (f/o Roger_&_Bridget) Michael and (-----) (-----), circa 1684.3 On 6 Nov 1684 Mr. Jarvis Baggale complained that Bridget, a recent widow and now Bagalle's wife, did with Edward Brotherton "illegally accompany together and keep him from his habitation." Baggale requested the court's protection; ordered that the sheriff give notice to Brotherton and Bridget Begalle to appear tomorrow to answer the complaint.4 As requested by Mr. Gervas Baggale on 13 January 1684, it was ordered that an inventory be taken of the estate of Griffith Savage (deceased) so his son Griffith could receive his share. George Hope and Thomas Nixson were to inventory the estate and Gervis Beggale and his wife Bridget were to appear to give oath. However, the order was stopped by Bridget's complaint to the Governor and Begalle was ordered to give security for his appearance at the next general court, who allegedly dismissed the complaint. Since no order appeared from the Governor, the court ordered that Bridget Begalle prove Griffith Savage's will by the next court so the child's part could be secured and so inventory could be taken. All persons concerned were ordered to appear at the next court.5 On 12 May 1685 Mr. Gervis Baggale informed the court that "he went in dread and fear of his life by Edward Brotherton." The court ordered that Brotherton remain in the sheriff's custody till posting security for keeping the peace to everyone, but especially to Begalle. Bridget Bagale was fined 50 lbs tobacco for "profanely swearing in open court." She was taken into the sheriff's custody till giving bond for "good behavior for misdemeanors and threats used in open court against the court." Gervas Baggale complained to the court that Edward Broderton indecently accompanied with Bridget, wife of Baggale. He had reasons to distrust her and believed that "Bridget Begalle and Edward Broderton have had carnal knowledge together." It appeared to the court that Broderton had boasted that he had a child by Bridget and that "he had lain with her before the said Gervas Beggalle and would still." Circumstantial evidence strengthened the suspicion, so the court ordered that Broderton be taken into the sheriff's custody and remain there till giving bond "that he forthwith refrain and shun (and always hereafter) the said Bridget's company." He was also to give a bond for good behavior and court charges. Deposition of Abraham Dorton aged about 63 years: About the end of last September Dorton was hired to attend Mr. Gervas Baggale, who was then very sick. Edward Broderton came to the plantation (which formerly belonged to Griffin Savage) where Baggale was; Baggale warned Broderton away, but "Edward Broderton often said he had more to do there than Mr. Baggale had and gave the said Baggale many ill words, biding him begone out of doors, and if he, the said Bagale, was not lame, he would knock his brains out, further saying that she (pointing at Bridget Baggale) was his wife and none of Mr. Bagalle's, and further said to the said Baggale, 'Do not you know that child on her lap is my child?' Mr. Baggale answered, 'No.' Then Edward Broderton replied, 'But it is, and you knew that well enough.'" The next morning Dorton saw that "Broderton came out of the bed from Bridget Bagalle only in his shirt." At the last February court, Dorton had heard "Broderton say that he lay with Mr. Baggale's wife before Mr. Baggale did, and since, and would do it again, and what was that to him?" Signed and sworn in open court 12 May 1685, by Abraham 'A' Dorton. Deposition of John Baggwell aged about 46 years: At the last February or March court at Mr. Jno. Cole's, Baggwell heard "Mr. Baggale then saying that Edward Broderton was a very courteous man, for when he could not lie with his wife himself, he (Broderton) would. Edward Broderton replied that '(I) lay with her before you did, and since, and what's that to you?'" Signed and sworn in open court 12 May 1685, by John Bagwell.6 On 19 Mar 1688/89 Gervas Bagaly aged about 30 years gave depostion: In June 1686, Bagaly went with Benjamin Eyres to Mr. Thomas Welborn's house. Eyre brought a note from Mr. Henry Parkes for a horse. Welborne said he might have him and went part way into the neck to show the horse to Eyres, but the weather was very hot, and they could go no further. Signed and sworn in open court on 19 March 1688/89, by Gervas Baggale.7 On 19 Sep 1689 Garvis Baggale aged about 32 years gave depostion: In 1688, Joseph Brickhill requested Baggale to dispose of the tobacco that Brickhill had at Wm. Bunting's. When Baggale asked Bunting for the tobacco, Bunting warned him about meddling with Brickhill's tobacco until Brickhill had paid a debt he owed to Bunting. Signed and sworn in open court 19 September 1689, by Garvas Baggale.2

Mary Brotherton (bastard d/o Edw Brotherton & Bridget Savage) was born in 1682 at Accomack Co, VA.1,3 She was named as a bastard child on 4 January 1682/83 at Accomack Co, VA. On 4 Jan 1682/83 Mrs. Bridget Savage was presented by the grand jury for having a bastard child.3 The premise for naming the bastard child of Bridget Savage and Edward Brotherton as Mary and showing her marring a Richard Sanders, is based on the 1721 will of Edward Brotherton, wife Mary, giving half his land to a Solomon Sanders, son of Richard and Rachell Sanders, and saying that land was the land he was living on, the part where the Sanders were then living. The assumption is that Brotherton had taken in his bastard child and tried to provide for her and her descendants by letting them live on his land up until he died and then dividing his land equally between them and his lawful daughter.1 As of circa 1698,her married name was Saunders. She married Richard Saunders circa 1698. The premise for naming the bastard child of Bridget Savage and Edward Brotherton as Mary and showing her marring a Richard Sanders, is based on the 1721 will of Edward Brotherton, wife Mary, giving half his land to a Solomon Sanders, son of Richard and Rachell Sanders, and saying that land was the land he was living on, the part where the Sanders were then living. The assumption is that Brotherton had taken in his bastard child and tried to provide for her and her descendants by letting them live on his land up until he died and then dividing his land equally between them and his lawful daughter.2 Mary Brotherton (bastard d/o Edw Brotherton & Bridget Savage) married Thomas Townsend before 4 April 1704 at Accomack Co, VA. It was on this date that administration on the estate of Richard Sanders was granted to Thomas Tounsin (Townsend?) who had married Mary Sanders, the widow of Richard Sanders, who had died intestate with Thomas Boniwell and Thomas Mills securities.2 As of 4 April 1704,her married name was Townsend.2 Mary was named as administrator of an estate on 4 April 1704 at Accomack Co, VA. It was on this date that administration on the estate of Richard Sanders was granted to Thomas Tounsin(sic) (Townsend) who had married Mary Sanders, the widow of Richard Sanders, who had died intestate with Thomas Boniwell and Thomas Mills securities.2 She died before 3 September 1721 at Accomack Co, VA. She was evidently dec'd by this date as Edward Brotherton named Solomon Sanders, son of Richard & Rachell Sanders and also Mary Sanders, daughter of Richard & Rachell Sanders in his will.4

Edward Brotherton1
M, b. 1649, d. before 3 October 1721
Edward Brotherton was born in 1649.1 He was on the list of tithables at Accomack Co, VA, in 1674. He was shown as Edw. Brotherton with 2 tiths in Mr. Jno. Wise's precinct.2 He bought land in 1674 at Parksley, Acc Co, VA. It was in this year that Edward Brotherton bought the Teage Anderson half of tract A106 (southwest of Parksley) from Peter Walker & his wife Elizabeth. In 1698 the justices found Brotherton guilty of "possessing counterfeit money." In 1689 Brotherton sold his 250 acres to Richard Greenall, who wife, when he later died, was a Mary.3 Edward witnessed a will on 6 July 1680 at Accomack Co, VA. It was on this date that Edward Brotherton, Roger Mikell & William Prettiman witnessed the will of Griffith Savage, wife Bridget.4 On 7 Apr 1685 Edward Brotherton aged about 36 years gave a deposition: Mr. Francis Lee gave Brotherton orders to receive a hogshead of tobacco upon the account of John Bagwell. Signed and sworn in open court 7 April 1684, by Ed. Brotherton.5 On 12 May 1685 Mr. Signed and sworn in open court 12 May 1685, by John Bagwell.1 He bought land in 1688 at Jobs Island, Acc Co, VA. It was in this year that John & Mary Truitt of Somerset Co, MD, sold his 200 acres and 50 acres of marsh (on Jobs Island, between Young's and France Creeks) to Edward Brotherton, who in 1721 (wife Mary) left half to his daughter Mary and the rest to Solomon Sanders, son of Richard and Rachell Sanders. Nothing more was found recorded about Sanders, but it may be that he died and the title reverted to mary Brotherton. She later married Southy Rew and in 1744 the Rews sold as 300 acres to Arthur Emmerson.6 He was security on the administration of an estate on 20 June 1693 at Accomack Co, VA. The assumption is that Brotherton had taken in his bastard child and tried to provide for her and her descendants by letting them live on his land up until he died and then dividing his land equally between them and his lawful daughter.13 |
