Elizabeth 'Betsy' Wallop was born circa 1805 at Accomack Co, VA. Elizabeth was named as an heir on 29 November 1815 at Accomack Co, VA. Charles Marshall, dec'd, the 4th brother of George Marshall the elder, who left: William Wallop & Revell (sic) Wallop, & Sally, Elizabeth, & Nancy Wallop, infant children of William & Bridget Wallop dec'd, formerly Bridget Marshall, a daughter of Charles Marshall. (NOTE: Revell should be Rosell.).1 Elizabeth was named as an heir on 3 April 1823 at Accomack Co, VA. William Wallop, the son of Elizabeth Wallop who died in 1792 & Skinner Wallop who died in 1816 (sic), died and left 4 children, viz: Sally Welburn, wife of William Welburn, Betsy Wallop, William Wallop & Rosella Wallop.2 As of circa 1825,her married name was Hayes. She married (-----) Hayes circa 1825. As of 9 April 1827,her married name was Marshall.3 She married George Esme Marshall, son of George (of Esme) Marshall, on 9 April 1827 at Worcester Co, MD. He was shown as George Esme Marshall and she as Elizabeth Hayes. No other information was given..3 Elizabeth 'Betsy' Wallop sold land on 2 October 1831 at Accomack Co, VA. It was on this date that Stringer Marshall and Roselle T., his wife and George E. Marshall and Elizabeth, his wife sold William Welburn, Sr. for $30 for 25 acres of Wallops Hammock on Wallops Island being land which William Wallop got of his father Skinner Wallop.4

She was shown as only my wife in the will of Immanuel Halle. Marshall's note shows that Eustace Peasons married the mother of the 3 orphans of Emanuel Hall.2 As of after 28 May 1666,her married name was Parsons.2 She married Eustace Parsons after 28 May 1666 at Northampton Co, VA.2 Cattle marks were recorded in 1676 for Grace Parsons the daughter and for Anne Parsons the wife of Eustice Parsons, Anne's mark being formerly the mark of Henry Mitchell.3 Ann was named as an heir on 28 August 1679 at Northampton Co, VA. It was on this date that Anne Fathrey, aged 16, witnessed the will of William Beadle, who left his entire estate to the mother of Anne Fathrey and she was to pay his debt to Thomas Eyre. The dec'd's estate was placed in the custody of Anne Parsons.4

John James was born circa 1625. On 30 Mar 1651 John James was among many who signed an oath to be true and faithful to the Commonwealth of England as it is now established without King or House of Lords.2 He patented land between 1654 and 1661 at Northampton Co, VA. Part of Whitelaw's tract A1 east of Belle Haven was first patented in 1654 to John Gray for 300 acres. Gray assigned to John James, he to Alexander Draper, he to Edward Southern, he to Robert Hart, who finally assigned to Edward Smith, who obtained his own patent in 1661.3 He married Mary (-----) circa 1660.4 John James was named as a headright on 21 April 1663 at Accomack Co, VA. He was shown as John James on a certificate granted to Richard Bundick for 600 acres of land. On 12 Jul 1664 this certificate was evidently combined with another of Richard Bundick's for a total of 1400 acres on the Sea Board of Accomack Co, begining at land of Col. Edmund Scarburgh, bounded on the South by Longtone Branch &c. Lucy Ames Edwards says it was north of Metompkin Inlet.5,6,7 On 3 Mar 1679/80, Mary James, aged 42 the wife of John James, and Sara Masman gave depositions that John Taylor, on his deathbed stated he was indebted 1000 lbs tobacco to Capt. Walker.4 John witnessed a will on 1 March 1681/82. It was on this date that John James and Charles Perks witnessed the will of John Mattison, planter.1 He died before 28 August 1683 at Northampton Co, VA. It was on this date that the will of John Mattison, planter, was probated and it was noted that one of the witnesses, John James, is dec'd.1

It was on this date that according to the depositions of Sara 'X' Masman and of Mary James aged 42 the wife of John James, on his deathbed the dec'd stated he was indebted 1000#t to (Capt.) Walker. Apprs: Henry Masman, Charles Parkes, Francis Pettitt. The court ordered Henry Masman to sell the estate at public outcry.3

Thomas Riley was born circa 1703 at Somerset Co, MD.1 Thomas was named in his father's will on 19 October 1709 at Somerset Co, MD. He was shown as my son Thomas Raly (under age 18) in the will of Lawrence Rily, wife Tabitha.1 Thomas was listed as a tithable in Bogerternorton Hundred in 1723 (Somerset County Court, Maryland, tax lists 1723-1759 [MSA C1812]; 1723 household #67) living in the household of his step-father Robert Hill (Barbara Massey Horsman, The Massey Family of Worcester County, Maryland). A young man was taxable at 15 years of age. Thomas Ryley (also Riley, Rioly, Railey, Realy, Reily, Reyley and Ryly) who remained in Hill’s household through at least 1727 (1728 was missing and 1729 was illegible), was the head of his own household in 1730. It was stipulated in his father’s will that he remain in school till he was 21 years old. He was probably at least 21 in 1727 when he appears to have left home. (Somerset County Court, Maryland, tax lists 1723-1759 [MSA C1812]; 1723 household #67, 1727 Household #95, 1729 household 36, 1730 household #68).2 He married Rachel Peale, daughter of Thomas Peale II and Ansley 'Anslee' Savage, circa 1732 at Worcester Co, MD.3 Thomas made a will on 17 April 1751 at Worcester Co, MD. In the Name of God amen, the seventeenth day of Aprile in the year of our Lord one thousand seven hundred and fifty one, I Thomas Rily of the Province of Maryland in Wocester County being very sick and weak in body, but of perfect mind & memory Thanks be given to God therefor Calling now(?) to mind the mortalety of my body and knowing that it is apointed for all men once to dye, do make & ordain this my last Will and Testament That is to say Principally and first of all I give and Recomend my soul into the hands of God that gave it and fore my body I recomend it to the earth to be buried in a Christian like and decent manner at the descretion of my Executor nothing doubting but at the general resurrection but I shall receive the same again by the mighty power of God and as touching such worldly Estate wherewith it hath pleased God to Bless me in this life, I give devise and dispose of the same in the following manner and form___ Imprimis I give and bequeath unto my beloved son Stephen Rily one hundred acres of Land part of my Tract called Newport Pannel and his and Assigns forever, where Adam Greayer now lives Beginning at a bunch of marked Poplars with four notches in each and from thence up the branch binding all along on the high Land on the same side the branch to poplar stands on continuing the same course untill it is run so far as to contain the sd. Tract begining at the old Beaver Dam Where Burtons line and mine joyns thence down the sd. Beaver dam to the division line between Watts's land and mine Thence along the same so far as to contain the said Qyantity by runing a line right across to mine & Burtons line, and the same to him his heirs and Assigns forever begining at a forked Poplar it being a line Tree of my land where the line runs across the bottom of the Neck dividing his high land from mine and from thence runing wright out three Chane from the said forked poplar and runing from thence each way a line paralel to the old line so as to make the sd. land three chane wide at each end let the same be more or less provided that the said John Donelson does make over his marsh that lyes between my lines and Burtons begining where Burtons lines and mine intersects and runing down to a gut issuing out of the small small Creek which his marsh bounds on oposite to where he lives to my son Thomas Rily his heirs and Assigns forever___ Item I desire that Elias Eavens may have the place where he now lives Six years paying the rearly rent of Eight pounds to my Executrix at the end of each year but if he the said Elias Eavens does not pay each years rent at the End of the year then he shall be disposest and have no rite to the place any longer which rents I desire my Executrix may pay unto my son Levin Rily at the age of twenty one years___ Item I desire that Thomas Peel may live where Adam Graeyer now lives he also paying the yearly rent of five pounds ten Shillings to be paid to my Executorix untill my son Stephen Rily comes to the age of twenty one years, which rents I desire may be paid unto my son Stephen Rily at the age of twenty one years___ Item I give and bequeath unto my beloved son Thomas Riley Two Cows and Calves and six Ewes and lams and all my Lands to him and his heirs forever not there before given___ Item I give and bequeath unto my beloved Daughter Elizebeth Rily a third part of all my moveable Estate to her, her heirs and Assigns forever___ Item I give unto my Daughter Tabitha Rily a third part of my Moveable Estate and to her heirs and Assigns forever Lastly I give unto my beloved Wife Rachel a third part of my Moveable Estate, whom I also Constitute make and ordain my whole and sole Executorix of this my last Will and Testament. and I do hereby Utterly disallow revoke and disanul all and every other former Testaments Wills or Will and Executors by me before this time named Willed and bequeathed Ratifying and Confirming this and no other to be my last Will and Testament in--Whereof I have hereunto set my hand Seal the day and year above written. Comry. of Worcestor Coty. June ye 7th 1751 came Rachl. Item I give and Bequeath to my beloved wife Ann Riley all the Lands I am possest of with all the improvemants Thereunto belonging. During her widowhood Item I give and Bequeath to my son Thomas Riley after my wifes widowhood one hundren and fifty Acres of Land more or less it Being my Part of a Tract of land called newport pennel with privilege of wod and Timber on the place called Bowens Discovered To him his heirs and assigns forever Item I give and to my son William Riley the sixty seven acres of Land that I baugh of having ton (?) with privlege of Pasture on the place called Newport pennel after my wifes Widowhood to him his heirs and assigns forever Ten Acres of the said Land excepted which I give and Bequeath unto William Watts in consideration of payment Received for The Same to him his heirs and Assigns forever Item I give and bequeath one Negro wench called Nance between my son Littleton Riley and my Daughter Elizabeth to them their heirs and Assigns forever Item I give and bequeath to my son Isaac Riley one negro boy called grant and pair of Silver Shoebucels to him his heirs and Assigns forever Item I give and Bequeath to my son James Riley one Negro girl called Lidda to him his heirs and Assigns forever Item I give and Bequeath further give and Bequeath to my said wife all the Remainder of my moveable Estate not before given away During her widowhood whom I likewise Constitute and ordain my sole executrix of this my last will and Testament Signed Sealed and Acknowledged by the Above named Thomas Riley for his Last Will and Testament and hath hereunto set his hand and Seal the Day and date above written. Singed: Thomas Thomas Riley. Witness: Benjamin Mills, Levin Riley, Rebecca Riley, Tabitha Marcheent.3 He died before 17 June 1778 at Worcester Co, MD. It was on this date that his will was probated. Then came Ann Riley & made Oath -- that the within Instrument of writining is the true & Whole Will & Testament of Thos. Riley late of worcester County that hath come to her hands or possesion and that She doth not know of any other. Ss Wm. Morris Regr Will for Wor. County Worcester County Ss June 17th 1770. Then came Levin Riley, Rebecca Riley & Tabitha Marchment three of the Subscribing Witnesses to the within last Will & Testament of Thomas Riley late of worcester Coty deceased made Oath & that they did see the Testator therein Named Sign & Seal this Will and that they heard him publish pronounce and declare the same to be his Last Will & Testament that at the time of his so doing, he was to the Best of their Apprehensions of Sound disposing mind memory & understanding, and that they respectively Subscribed their nemes as Witnesses to this Will, in the presence and at the Request of the Testator & in the Presence of each other and that they saw Benjamin Mills one of the witnesses of the within will Subscribe his names as a Witness therto. Reginald 'Renoles' Badger was born in 1662.2,3 On 6 Feb 1672/73 Richard Bayly's servant boy named Reynold Badger was judged to be 11 years old.2 On 27 May 1679 deposition of Reignald (sic) Badger aged about 17 years: About the end of January, Richard Hovington (who, along with Badger, served Mr. Richard Bally at the time) was about to fell a large pine that stood near a new forty foot tobacco house. He asked Badger which way he thought the tree would fall, but did not wait for a reply; Hovington said the tree leaned toward the branch and about sunset went to work felling the tree. The next morning Hovington shifted the notch to the other side, then with the wind blowing hard and the tree almost down, Hovington cried out, "I am undone, I am undone." Badger advised Hovington to let the tree alone "for it will go upon the house." But Hovington answered, "No, no," and kept felling till the tree was down. Signed 27 May 1679, by Reignald (25) Badger.3 He was named as a headright on 18 February 1690 at Accomack Co, VA. He was shown as Reynold Badger on a certificate granted to Mr. Richard Bayly for 700 acres of land.4 On 8 Nov 1690 Mary Turner was presented for fornication and having a bastard child. Mr. Richard Bally, her present master, confessed judgment for her fine. Ordered that he pay the 500 lbs tobacco to the church wardens; in return Mary was willing to serve her master according to law. Upon being examined in open court, Mary Turner swore that Reynold Badger was the father of her child. Ordered that he be taken into custody till giving security to answer at the next court.5 On 18 Mar 1690/91 Mary Turner swore that Reynold Badger was the father of her bastard child. Now Badger appeared with Richard Bally, who acknowledged himself as security to save the parish from supporting the child. In exchange for Richard Bally providing the above security, Reynold Badger gave to Bally's daughter Elizabeth the child born to Mary Turner. The child, named Ursula Turner, had turned one year old on 16 March; she was ordered to serve Elizabeth till attaining lawful age. Also on this same date Mr. Richard Bally had been allowed 600 lbs tobacco from last year's parish levy for six months' nursing of Mary Turner's bastard child, of which Reynold Badger was the reputed father. Now Badger acknowledged judgment for the 600 lbs tobacco "and tendered payment immediately, having kept tobacco at ye said Mr. Richard Bally's, where he made his crop." Ordered that the sheriff receive the tobacco from Badger and be accountable for it at the next parish levy.6 He married Mary James, daughter of David James and Joan (-----), circa 1692.1 Reginald 'Renoles' Badger bought land in 1693 at Accomack Co, VA. It was in this year that Reynold Badger bought 150 acres of tract A64 from Edmund & Elizabeth Scarburgh, it being the northwest of the Bayly land and extending along the western bounds of the tract. In 1748 Reginal Badger left to his son Jacob, who died intestate in 1754, leaving a widow Ann and a son John as heir-at-law. In 1784 John Badger, wife Elizabeth, also died intestate; no heir was indentified, and in some undertermined way the property came into the hands of Brown Bradford, who in 1795, wife Peggy, left the same land to a son John Brown Bradford.7 On 20 Nov 1696 Reynold Badger was granted a judgment of 415 lbs tobacco against Samuel Beech, who denied that 70 lbs tobacco was paid to Robert Taylor [presumably for Beech]. Since Badger could not prove the 70 lbs, Beech was ordered to pay 415 lbs tobacco and court costs.8 He was named as a headright on 5 April 1698 at Accomack Co, VA. He was shown as Renald Badger on a certificate granted to Mr. William Bradford for 600 acres of land, 7 rights being by assignment of Maj. Richard Bally and 5 in his and the said Bradford's own right.9 Reginald was named as a guardian on 4 September 1711 at Accomack Co, VA. David Taylor, orphan of Thomas Taylor, chose Renals Badger for his guardian. The court approved and ordered Badger to take Taylor's estate into his possession after giving security.10 On 2 Apr 1712 it was recorded that at the last court Regnall Badger (guardian of David Taylor, son of Thomas Taylor, deceased) brought action against John Wylie (administrator of the estate of Thomas Taylor), who asked to answer at this court. When he failed to answer, Badger's attorney (Mr. Phillipson) moved that an account be given of David's estate. Badger chose Capt. Henry Scarburgh and Wylie chose Mr. William Burton; they were both ordered to state the account and other matters in dispute and report to the next court.11 He married Bridget (-----) circa 1740.12 Reginald made a will on 27 September 1748 at Accomack Co, VA. To son Jacob Badger plantation where I now live. To son John Badger land bought of Morris Shepherd. To Frances Badger. To Leanna, the daughter of Frances. Daughter Anne Moore. To daughter Rachel Lurton's 2 children, Henry & Hannah. Daughter Sabra. To Joseph Gunter. To grandson David, son of Nathaniel Badger. Wife Bridget. Sons John & Jacob residual legatees & Exrs. Witt: William Spiers, John Phillips, Robert Barry.12 He died before 27 December 1748 at Accomack Co, VA. It was on this date that his will was probated. Stephen Harrison was appointed guardian to the heir-at-law.13

He was shown as grandson-in-law (meaning step-grandson) William James in the will of William Parker. He was given planation where I now live containing 200 acres. According to Whitelaw, this was the 200 acres William Parker had bought from Tabitha Hill in 1703. In 1757 James gave 100 acres to his son Thomas. In 1764 William and Amey James sold 50 acres to James Twiford, to become merged with some adjacent land of his. In 1765 William James (wife Amey) left his home plantation of 109 acres to his son Thomas, who (wife Sarah) died intestate in 1783. (NOTE: This William Parker had married the widow Sarah Spiers, who had a daughter Mary who married Jonathan James of Accomack and she had another daughter Sarah who married William James of N'hamp. Evidently both of these daughters had sons named William James. The assumption is that the land went to the William James of N'hamp as his father William in his will of 1715 named a friend William Parker to see to the proper care of my children's estate during their minority. This William Parker also named David James another son of his friend William James of N'hamp.).3,4 William chose a guardian on on 8 November 1727 at Accomack Co, VA. It was on this date that William James chose his guardian Delight Shield, who posted bond..5 On 9 Jan 1728/29 upon the petition of Delight Shield (guardian of William James, orphan), Nathaniel Savage and his wife were ordered to deliver all of the orphan's estate to Shield.6 He married Amey (-----) circa 1734.7 William was named in his father-in-law's will on 9 January 1744 at Northampton Co, VA. He was shown as my son-in-law (meaning step-son) in the will of Spencer Johnson, wife Sarah.8 He bought land in 1754 at Accomack Co, VA. It was in this year that William James, who already owned the William Parker part, bought another adjacent 149 acres of tract A64 from James Twiford.9 He deeded land as a gift in 1757 at Accomack Co, VA. It was in this year that William James gave 100 acres of tract A64 to his son Thomas.4 He was named in processioners returns in 1764 at 3rd District, St. Georges Parish, Acc Co, VA. The 3rd Precinct from Bowmans Branch to Burtons Branch. To wife Amey during her life or widowhood, my manor plantation and after her death or marriage to son Thomas James plantation where I live being 109 acres & for want of heirs to my daughter Fanny James. He also gave son Thomas a handmill, large cupboard and pewter. To daughter Johannah Bradford for life, reversion to her 4 daughters Retter, Leagh, Fanny & Mettelder some cattle. To daughter Margaret Lurton for life, reversion to her 2 daughters Tabitha & Semer Lurton some cattle. To daughter Sarah Foskey for life, reversion to her 3 sons Luke, George & John Foskey some pewter. Daughters Susannah James a bed and furnishings, oval table called the best, spinning wheel, pewter and a brown ewe and lamb. To daughter Rachel James bed and furnishings, pewter, couch, linning wheel, 1 cow and calf and 1 ewe and lamb. To daughter Fanny James one riding horse and side saddle, 1 linning wheel, 1 oval table, pewter and a heifer and ewe and lamb. Wife Amey to be Extr. Bridget (-----) was born circa 1700.2 She married Thomas James, son of David James and Joan (-----), circa 1716 at Northampton Co, VA.2 As of circa 1716,her married name was James.2 Bridget was named as administrator of an estate on 13 November 1726 at Northampton Co, VA. It was on this date that administration on the estate of Thomas James was granted to Bridget James, widow of the dec'd.1 As of before January 1733/34,her married name was Smith.3 She married William Smith before January 1733/34 at Northampton Co, VA.3 Bridget (-----) died before December 1737 at Northampton Co, VA. In Dec 1737 Phillip Jacob, planter and Ann his wife and daughter of Thomas James who died intestate in 1726, show that Thomas James died possessed of sundry Negro slaves: Betty, Bob, Mary, Cush and Glasgow. He left 2 children - Robert and your petitioner's wife Ann. The widow Bridget afterwards married a certain William Smith and had administration of Thomas' estate. A distribution was made by the court on her prayer. She was assigned as dower Cush and Glasgow. Moll, daughter of the slave Mary, was born after the said Thomas' death and before the distribution in which she was not considered. Ann, who was then an infant, has received no part of the slave, Moll. Bridget has since died and as heir-at-law Robert James has claimed Cush and Glasgow. He hes refused to make any distribution to his sister Ann Jacob, nor will he give her one moiety of the slave Moll. Robert James is called to answer. He states that he will not give any part of Cush and Glasgow who belong to him as heir-at-law. However, he is agreeable to divide the Negro, Mull.4

Michael James was born circa 1754 at Northampton Co, VA.1 In May 1759 in N'hamp County Court, Elizabeth James, widow of Robert James petitions in behalf of William, Peggy, Robert, Michael & Bridget James children of the dec'd. The said Robert died intestate leaving several slaves: Glasgow, Cush, Daniel, Joshua, Dido, Abraham and Grace. The plea is for Thomas James, son and heir-at-law to the dec'd Robert to pay the above named children their shares of the slaves. Thomas James, an infant is represented by Nathaniel Savage, his guardian. He agrees to the division, after laying out the dower of the said Elizabeth. Case dismissed for want of prosecution.1 He married Bridget (-----) circa 1825.2 Michael James died before 8 November 1830 at Northampton Co, VA. It was on this date that administration on the estate of Michael James was granted to John Addison, the widow Bridget relinquishing her right of administration.2 On 13 Aug 1832 the following were named as heirs-at-law of Michael James, late a Lieutenant in the Virginia State Navy: Cassandra Mapp wife of John C. Mapp, Michael R. Savage, Susage Wescoat wife of Hezekiah, John Savage, George Savage, Robert Rodgers, James Rodgers, Jane Rodgers, Edward Rodgers, Robert James, Peggy Savage, Rosey Johnson wife of Jeptha, William Addison of Thomas & Betsey Bunting.3 On 10 Sep 1832 it was recorded that Michael James, on whose estate John Addison administered in this Court, was a native of N'hamp Co, VA, where his relations and those entitled to distribution of his estate reside. He was a Lieutenant in the Navy of Virginia in the Rev. War and served to the end of the War. He was retired by the board of officers of Virginia in 1784. John Addison administered on the estate of the said Michael James with the approbation of the heirs entitled to distribution of the estate, for the express purpose of receiving from the State of Virginia the amount in money due in half for life for the said Michael James. John Addison appoints Thomas M. Bayly of the County of Accomack to receive money due to the estate from the United States under Act of Congress of 5 Jul 1832, entitled "An Act for liquidating & paying certain claims of the State of Virginia."4 On 13 May 1833 it was recorded that Michael James who was a Lieutenant in the Virginia State Navy in Rev. War died intestate, leaving one child who died shortly after the death of her father, an infant intestate & without issue. Michael James left no other child or descendant or any other child. The said Michael James left at his death the following brothers & sisters who are his heirs-at-law, and no other brothers or sisters or descendants of any other brother or sister: Bridget James & Susan Savage, formerly Susan James who were sisters of the whole blood to said Michael James; and five brothers & sisters of the half blood, viz: Thomas James, Robert James, Peggy Bool, Elizabeth Savage and John Ewing. Said Bridget James has lately died having devised her whole estate to John C. Mapp the younger, William W. Mapp, Alfred N.H. Mapp and Robins W.W. Mapp. Said Susan Savage has died intestate leaving as her heirs-at-law her children Michael Savage, Susanna, wife of Hezekiah P. Wescott, George Savage and Ann R. Rodgers. Said Ann R. Rodgers is since dead intestate leaving as her heirs-at-law her children Robert, James, Edward & Jane Rodgers. Said George Savage has also died intestate leaving as his heirs-at-law his children John & George. The said Thomas James has died intestate leaving as his heirs-at-law his children Elizabeth the wife of James Poulson, Cassanddra the wife John C. The said Robert James, the half brother of Michael James, has died intestate leaving the following heirs-at-law, viz: his children Thomas James & Ainsley Dennis, formerly Ainsley James, and the following grandchildren, viz: William Oague, who was the only child of his dec'd daughter Susan Oague, formerly Susan James, also Robert D. James, Abel James, Susan Dowty the wife of James Dowty, and one great grandchild, viz: Maria Scott, the only child of Maria Scott dec'd; the said Robert O. James, Abel James, Susan Dowty and Maria James Scott being the only children of Sally James, daughter of said Robert James & also the children of Arthur Addison, whose names are unknown to the Court, by his dec'd wife, who was another child of said Robert James. The said Peggy Bool has died intestate leaving three children, viz: Wm. Addison, Elizabeth Bunting & Robert Addison, the said Robert Addison has since died intestate leaving children whose names are unkown to the Court. The said John Ewing has since died intestate leaving Victor Ewing his only child & heir-at-law. The said Elizabeth Savage, the half sister of the said Michael James is now living.5

The said Robert died intestate leaving several slaves: Glasgow, Cush, Daniel, Joshua, Dido, Abraham and Grace. The plea is for Thomas James, son and heir-at-law to the dec'd Robert to pay the above named children their shares of the slaves. Thomas James, an infant is represented by Nathaniel Savage, his guardian. He agrees to the division, after laying out the dower of the said Elizabeth. Case dismissed for want of prosecution.2

Ann James was born circa 1718 at Northampton Co, VA.1 In Jan 1733/34 Ann James by her guardian William Smith, complains that her father Thomas James, Gent., died intestate leaving her, his daughter Ann and her brother, his heirs. He was possessed of 2 Negro women named Mary and Betty and one Negro boy named Robin all living. She is advised that she is entitled to one half of the value of the slaves. However, her brother Robert denies that she has any right to the half interest in the slaves. He, being under age, claims he is unable to divide and pay the said Ann her moiety. All are contrary to equity; the said Ann is abiding by the strict rules of the Common Law. The said Robert is called to Court to answer.2 As of circa 1736,her married name was Jacob.1 She married Phillip Jacob, son of John Jacob and Mary (-----), circa 1736.1 In Dec 1737 Phillip Jacob, planter and Ann his wife and daughter of Thomas James who died intestate in 1726, show that Thomas James died possessed of sundry Negro slaves: Betty, Bob, Mary, Cush and Glasgow. He left 2 children - Robert and your petitioner's wife Ann. The widow Bridget afterwards married a certain William Smith and had administration of Thomas' estate. A distribution was made by the court on her prayer. She was assigned as dower Cush and Glasgow. Moll, daughter of the slave Mary, was born after the said Thomas' death and before the distribution in which she was not considered. Ann, who was then an infant, has received no part of the slave, Moll. Bridget has since died and as heir-at-law Robert James has claimed Cush and Glasgow. He hes refused to make any distribution to his sister Ann Jacob, nor will he give her one moiety of the slave Moll. Robert James is called to answer. He states that he will not give any part of Cush and Glasgow who belong to him as heir-at-law. However, he is agreeable to divide the Negro, Mull.1 Ann was named in her husband's will on 6 May 1751 at Northampton Co, VA. She was shown as wife Anne in the will of Philip Jacob.3 She died before 10 October 1752 at Northampton Co, VA. It was on this date that administration on the estate of Anne Jacob was granted to Esau Jacob with Michael Christian and William Westerhouse securities on a bond of £100.4

Hezekiah James was the security on the M.L.B. of John Stott Sr. and Anne James, daughter of Thomas James who gave consent.2 He married Sabra Simkins, daughter of William Simkins and Sabra Roberts, circa 1766.1 Hezekiah was named in his brother's will on 23 August 1768 at Northampton Co, VA. He was shown as brother Hezekiah James and named Extr in the will of John James.3 He bought land in 1770 at Northampton Co, VA. It was in this year that Hezekiah James bought a part of tract N102 from Elias Eliason & his wife Annah. In 1798 he left this land to his son William and in 1826 he left it to his son Hezekiah P. James.4 He bought land in 1777 at Northampton Co, VA. It was in this year that Hezekiah James bought 109 aces of tract N115 (on the Bayside near Jamesville) from Jonathan & Betty Bunting and 3 years later he bought a balance of 75 acres. In 1798 he left this, his home place, to his son William and in 1826 he left all of his lands to hsi son Hezekiah P. James.5 He bought land in 1777 at Northampton Co, VA. It was in this year that Hezekiah James bought 100 acres of tract N103 from Jonathan Bunting and his wife Betty. He also bought 109 acres of tract N115 from Jonathan Bunting and his wife Betty and 3 years later they sold him a balance of 75 acres. In 1798 he left both of these tracts to his son William and in 1826 he left it to his son Hezekiah P. James.6 Hezekiah was named in his mother-in-law's will on 18 December 1778 at Accomack Co, VA. He was shown as my son-in-law Hezekiah James in the will of Sabrah Simpkins.1 He was the security on a M.L.B. On 12 April 1785 at Northampton Co, VA. Hezekiah James was the security on the M.L.B. of Robert Nottingham and Anne Johnson.7 He bought land in 1797 at Northampton Co, VA. It was in this year that Hezekiah James bought 217 acres of tract N112 from Smith Major (wife Elizabeth) and deeded it to his son Thomas the next year. In 1816 Thomas James deeded 70 acres to a trustee for the separate use of his wife Ann. In 1832 Thomas and Ann B. James began selling small lots of 3 to 10 acres, which may have been the beginning of the use of bay shore property for resort or pleasure purposes. In 1834 Ann B. James left the balance of her land to children Leavin T., Ann Alizur and Lloyd T. James. In 1822 Thomas James gave a deed of trust for the 150-acres balance to William James, who apparently foreclosed, and the title passed to a son John S. James, and in 1837 he and his wife Margaret C. James sold to Edward N. Johnson.8 Hezekiah made a will on 21 March 1803 at Northampton Co, VA. I give unto my son Thomas James a Negro man called James and Negro boy called Leven. My will and desire is for my son's great house to be completed out of my estate and kitchen. I give to my son Thomas James one hundred and twelve pounds, my hand mill and blacksmith tools. I leave the remainder part of my estate to be equally divided between my son William James and my son Thomas James. I leave my son William James and my son Thomas James my executors. Signed, Hezekiah James. Witnesses: John Pitts and Charles Kellum.9 He died before 14 October 1805 at Northampton Co, VA. It was on this date that his will was probated.9

James, who married Severn Savage.3 He married Anne Bagwell 'Nancy' Watson, daughter of Ephriam Watson and Tabitha (234) Wharton, on 15 December 1808 at Accomack Co, VA. John W. Watson was the security on the M.L.B. of Thomas James and Anne Bagwell Watson.4 Thomas was named in his mother's will on 25 December 1813 at Northampton Co, VA. He was shown as son Thomas James in the will of Sabrah James.5 He deeded land as a gift in 1816 at Northampton Co, VA. It was in this year that Thomas James deeded 70 acres to a trustee for the separate use of his wife Ann. In 1832 Thomas & Ann B. James began selling several small lots of 3 to 10 acres.6 He deeded land in 1822 at Northampton Co, VA. It was in this year that Thomas James gave a deed of trust for the 150-acres balance of his part of N112 to William James (his brother), who apparently foreclosed, and title passed to a son John S. James, and in 1837 he and his wife Margaret C. James sold to Edward N. Johnson.7 He died before 12 March 1833 at Northampton Co, VA. On 12 Jun 1833 the administration on the estate of Thomas James was granted to the sheriff. He had been dead for more than 3 months.8

I give to my daughter Sarah Ann James the mortgage that I hold against Thomas James. I give to my son John S. James one Negro man called Stepny and one called Lakum. It was on this date that Francis Gurney, John Spence, Randle Mitchell, William Christian, Rachel Johnson, Hezekiah Pitts and Stewart James witnessed the will of William McLaughlin of N'hamp County, shopkeeper, now in Philadelphia.2 He died on 9 March 1784 at Northampton Co, VA. It was on this date that administration on the estate of Stuart James was granted to Edmund Scarburgh. Thomas James was to be one of the appraisers.3
