On 4 Apr 1705 in Acc Co Court, William Robins and his wife Sarah (one of the daughters of Joseph Newton, deceased) and Ann Mary Newton (Sarah's sister) petitioned that their father had died possessed of a considerable estate. In an oral will, he had appointed Mr. Samuel Sanford and Mr. William Anderson overseers to divide the estate equally among his wife and children. The overseers inventoried the estate and delivered "to ye children then arrived to age their parts." The rest of the estate (such as livestock) belonging to the underage orphans was to remain with the widow and be divided as the children arrived to age. Afterward, Francis Benson (who married Edith, daughter of Joseph Newton) possessed himself of the estate and became guardian of Sarah and Ann Mary, but he did not take an inventory or post security. At the request of the plaintiffs, it was ordered that Francis Benson be summoned to the next court so the orphans could have their equal shares.2 Edith was named in her husband's will on 17 October 1722 at Accomack Co, VA. She was shown as wife Edith in the will of Francis Benston.4
