That a certain William Burton formerly of Accomack County, now dec., having a daughter then married to a certain John West, made his last will and testament in which he devised a number of slaves to his said daughter for life then to be equally divided between all her children; that the said Agnes West had nine children, one of whom named Katharine intermarried in her mother's lifetime with a certain Edmund Chambers and died before her mother and before any division could be made of said slaves; that after the death of the said Agnes the said Edmund Chambers obtained administration on the estate of his said wife, who was one of the said nine children, and a division was made among the complainants under the said Burton's will after a long and tedious litigation, and a slave named Lazar was alotted to the representative of the said Edmund's deceased wife without determining whether the right to the said slave vested in the son or the administrator of the deceased, as also the sum of 21 £ 16 s. and 8d for the proportion of the rent of the said slaves with interest from 23 Nov. 1766; that in consequence of the said partition and administration the said Edmund obtained possession of the said slave sometime in the year 1767 and sold him to your orator for a valuable consideration; that the said Snead held the said slave until sometime in the beginning of the year 1768 when he was spirited away and seduced from his service by Major Chambers, the son and heir of the said Catherine Chambers, one of the nine children aforesaid, and by a certain Jonathan Willett, and by them, after the said Willett had kept him in possession ____ years sold to the respondent &c. Catherine Chambers left at her death Major Chambers, her only son and heir at law, and a daughter Agnes. The defendant in his answer denies that the said Edmund Chambers had any right to any part of the slaves devised by William Burton, but only in right of his son, Major Chambers, one of the defendants; and that this will appear evident from a suit in chancery commenced in this Court by Jonathan Willet and Agnes, his wife, Garrat Topping and Scarburgh, his wife, Charles Crowson and Comfort, his wife, and Major West then plaintiffs vs. John West, Smith Bunting, Major Chambers, one of the present defendants, Thomas Goffigon & George Scott then defendants, in which it was decreed that the slaves devised to the said Agnes should be equally divided between the parties plaintiff and defendant, children and grandchildren of the said Agnes. To wife Matilda Rodgers whole estate during her widow & then to son Zorobabel Rodgers plantation where I now live & should both he & my son Thomas Wise Rodgers die without heirs then to my godson John Robison Waddy. To son Thomas Wise Rodgers 100 acres which I bought of Parker, & should both he & his brother Zorobabel die without heirs to my cousin George Radmond Riley, also the land I hold on Cedar Island. To son Zorobabel 21 acres in Penny Swamp. Sons Zorobabel & John Wise Rodgers residual legatees, & for want of heirs to my sister Elizabeth Waddy's children. Wife Matilda & sons Zorobabel & Thomas Wise Rodgers Exrs. Not witnessed. Proved by Joshua Taylor & Robert Twiford..4 Zorobabel died in January 1789 at Accomack Co, VA. That a certain Peggy Garrison late of this county, departed this life under the age of 21 years and without issue in the year 1821; that the said Peggy Garrison at the time of her death was possessed in her own right in fee simple of the undivided 1/3 of two tracts of land situate on the waters of Matshapungo Creek in this county, containing by estimation together 220 acres; that the said lands belonged to the said Peggy Garrison and Elizabeth and Charlotte Garrison as tenants in common, the principal part of the land having been devised to them by their deceased father, John Garrison, and the residue having descended to them from their deceased sister, Maria Garrison; that the said Peggy Garrison at her death left as her next of kin and heirs at law two sisters of the whole blood, viz: the said Elizabeth & Charlotte Garrison, and two brothers of the half blood, John W. and Samuel Garrison, and also left two nephews and their nieces of the half blood, viz: your orators and oratrixes, William, Sally, Margaret Smith & Elizabeth Garrison who are the children of Caty Garrison, dec., who was a sister of the half blood to the said Peggy Garrison &c.4
