He was shown as my grandson Thomas Bagwell in the will of John Eyre, son-in-law Samuel Burton. He also named a daughter Elizabeth and her husband Francis Stockley.2 He married Elizabeth Wharton, daughter of Francis Wharton Jr. and Rebecca Revell, circa 1733.3 Thomas died at Accomack Co, VA.3

     Robert was born circa 1653 at England. He was named as a headright on 17 November 1665 at Accomack Co, VA. He was shown as Robert Spencer on a certificate granted to John Davis for 400 acres.1 Robert Burton arrived in Accomack County prior to 18 Dec 1665 and declared, 19 Jan 1677/8, that he had "formerly gon under the name of Robt: Spencer from my infancy and now (was) better informed out of England by letters from my relations my true and right name is Robert Burton.2 He bought land in 1673 at Accomack Co, VA. It was in this year that Robert Spencer and Babtis Newcom bought 400 acres of tract A126 from Daniel and Anne Jenifer and then Spencer soon sold his interest to Newcom. Then in 1677 Baptist Newcom sold the 400 acres to Robert Burton. (NOTE: Robert Spencer and Robert Burton were the same person, as Robert Spencer starting going by Robert Burton in 1676.).3 He was on the list of tithables at Accomack Co, VA, in 1674. He was shown as Robert Spencer on Mr. Jno. Wise's list with 1 tith.4 He was on the list of tithables at Accomack Co, VA, in 1675. He was shown as Robt. Spencer with 1 tith on Capt. Rich. Hill's list.5 He was on the list of tithables at Accomack Co, VA, in 1676. He was shown as Robt. Burton with 2 tiths.6 He was on the list of tithables at Accomack Co, VA, in 1677. He was shown as Robt. Burton with 1 tith on Capt. Hill's list.7 He was on the list of tithables at Accomack Co, VA, in 1678. He was shown as Robt. Welburne's list.15 He was on the list of tithables at Accomack Co, VA, in 1691. James Askew was shown at Robt. Burton's with 1 tith on Capt. Wallop's list.16 He sold land in 1692 at Accomack Co, VA. It was in this year that Robert Burton and his wife Catherin sold his 400 acres on tract A126 to Richard Hinman.3 Robert Burton moved to Somerset Co, MD in 1692 and shortly thereafter to Sussex Co, DE, where he became a member of the Provincial Council of Pennsylvania and 14 Apr 1704, petitioned for a separate legislature for the people of New Castle, Kent and Sussex counties.2 He married Comfort (11) Bagwell, daughter of Thomas (4) Bagwell and Ann Stockley, circa 1710.2 Robert was named as administrator of an estate on 3 September 1717 at Accomack Co, VA. It was on this date that administration on the estate of Perry Leatherbury was granted to Robert Burton, his father-in-law, of Sussex County upon Delaware, as greatest creditor, with the consent of Edmund Leatherbury, brother of said Perry. William Burton & Samuel Welburne securities. (NOTE: Robert Burton was actually his step-fahter-in-law, having married Perry's widowed mother Comfort.).17 He made a will on 16 September 1724 at Sussex Co, DE.2,18 Robert died before 16 October 1725 at Sussex Co, DE.2,18

Esme was the eldest son of Thomas Marshall and shown as Ishmael on some documents. (Northampton Orders 1732-1742, pp. 405, 443; Accomack District Court Orders 1789-1797, p. 300, copied by James Marshall) He was in Worcester Co., MD by 1760. On 1 Sept 1764, Esme and Mary** sold 250A of 'Hog Quarter' to George Layfield and John Nairn for 5 shillings, Mary was under age. In 1767, he sold 269A in Northampton and purchased 'Rudder' at Pitts Creek Hundred. Esme's son, Thomas, bought 'Rudder' from Esme in 1772. 'Rudder,' 'Brittingham's Chance,' and 'Brittingham's Addition,' were all acquired by Esme from the widow of descendants of Elijah Brittingham. (Ruth T. Dryden, Land Records of Worcester Co. MD, pp. 75, 134, 394, 533) **The land abstract for 'Hog Quarter' shows Esme and wife Mary sold...she was under age. Mary Nairn was named by her grandfather in 1732, so she could not have been under age in 1764. It is suspicious that Mary Nairn died by 1764 and Esme married a second time to a Mary, possibly Mary Brittingham, daughter of Elijah. Mary Nairn is not named in the tri-partie agreement before the marriage of her mother, Janet Nairn, to Jabez Pitts, nor is she named in the 1771 will of her brother, John. The 1771 will of John Nairn, Mary's brother, provided the names of Mary and Esme's children, as Esme died without a will. Bonds were posted 5 Oct 1784 for the administration of Esme's estate in Worchester Co, MD by George Marshall, Thomas Marshall and John Marshall rejected the administration. Thomas and John Marshall provided inventory and the next of kin were listed as Levin and Theophilus Marshall.(Ruth Dryden, Worcester Admin. Bonds & Inventories, p. 15) John Nairn named the children of his sister, Mary: Thomas, John, Robert and William. NOTE: The George Marshall who administered the estate is probably the same George Marshall for whom Thomas, son of Esme, holds a mortgage in Worcester County. He is not named in the will of John Nairn as a child of Mary Nairn, nor is he named in the will of William Allen. Patience Marshall who married William Waller is not named by John Nairn or William Allen. George and Patience might have been children from Esme's second marriage; George may have been a child of the second marriage and Patience deceased by 1771. That they were children of Esme is not proved and based in large part on the names of their children--George Esme Marshall and Esme Marshall Waller. The 1810 census of Worcester County shows what looks like Isme or Ismel Marshall as 45+ with one female 10-16 and one female 26-45. If this is Isme, he is too old to be Esme's grandson. Again, neither John Nairn nor William Allen named an      Isme/Esme in their wills.4 Esme was named as an heir on 24 March 1771 at Worcester Co, MD. In his will of this date, John Nairne named Robert, Thomas and William Allen Marshall, sons of Esme Marshall; and also sister Mary Marshall's children..3 Esme died in 1784 at Worcester Co, MD.2

Her father only named two of her children in his 1761 will (Robert Henry Marshall and Elizabeth Marshall). Mary was not named in the Tri-Partie deed by her mother in 1767. In his 1771 will, John Nairn named the children of his sister Mary, but did not name her specifically. A deed for "Hog Quarter" abstracted by Ruth Dryden shows Esme Marshall and his wife Mary and that Mary was under age. It appears Mary Nairn died before September 1, 1764, the date of the deed for "Hog Quarter." He m. 2nd about 1764 Mary Brittingham, dtr of Elijah Brittingham & Sarah Newbold. She was called Mary Brittingham in her father's will. Esme Marshall and his under age wife, Mary, sold "Hog Quarter" for 5 shillings to George Layfield and John Nairn. Layfield and Nairn would have been relations to Esme's wife, Mary Nairn. Esme's first wife, Mary Nairn, would not have been under age in 1764. Mary Brittingham may have been Esme's second wife.3 She married Esme Marshall, son of Thomas Marshall and Patience 'V' (-----), circa 1745.2 Mary died before 18 April 1767.2 Mary was named in her brother's will on 24 March 1771 at Worcester Co, MD. In his will of this date, John Nairne named Robert, Thomas and William Allen Marshall, sons of Esme Marshall; and also sister Mary Marshall's children..1

Peden, Jr., Revolutionary Patriots of Worcester & Somerset Cos. MD, Willow Bend Books, Westminster, MD, 1999, p. 188) Mary Brittingham's will was probated in 1784; she named her daughter Deliliah Purnell and three grandchildren: Mary, Milby and Sarah. (Vernon L. Skinner, Worcester Co., MD Wills JW13, p.3) John Drummond is shown as the second son of Esme and Mary Marshall. He was under age in 1764. The "Maryland Herald & Eastern Shore Intelligencer" of April 22, 1800 shows Elizabeth Marshall and Benjamin Wailes as administrators of John D. Marshall late of Worcester County, Pitts Creek Hundred. (F. Edward Wright, Maryland Eastern Shore Newspaper Abstracts; Worcester Deeds Liber F, p. 217).3 He married Delilah Brittingham, daughter of Solomon Brittingham and Mary (-----), on 9 May 1793.3 John died before 22 April 1800.1
