"Eburn Byrd" named a wife Mary, a son Jacob (90 acres adjacent to Thomas Hargress); a grandson Jacob Byrd; a grandson Levi Byrd (105 acres); a daughter Mary Hornsby; a grandson Eburn Hornsby; a grandson Major Byrd; a son Jacob Byrd, a grandson Levi Byrd and daughter Mary Hornsby were residual legatees. Son Jacob Byrd, Executor. Wittness were John Wharton and Elizabeth Wharton (Acc Co Wills&c, 1767-1772, p. 160).. Ebron died before 31 May 1768 at St. George Parish, Acc Co, VA. It was on this date his will was probated. Littleton Dennis was appointed guardian of Levi Byrd, heir at law to the testator (Acc Co Wills&c, 1767-1772, p. 160)..4

Major was born after 1709 at Accomack Co, VA. He married Sarah (-----) circa 1730.1 In 1740 Major Bird purchased from Ansley and Tabitha Lingo 300 acres of land and marsh at Muddy Creek. It is doubtful that he left any male heir, as the land later was found in the possession of an Elizabeth Bird, who apparently remained unmarried, and a Lucretia who became the wife of Charles Broadwater (Whitelaw, pp. 1206-7). Major died in 1751 at Accomack Co, VA. He died intestate by 30 July 1751, when Sarah Bird, apparently his widow, was named to administer his estate (Orders 1744-1753, p. 516). Major Bird had bought 300 acres of land and marsh on Muddy Creek (north side) in 1740 and 100 additional acres in 1750 (south side) from Isaiah Johnson. This land descended to two daughters, Elizabeth Bird and Lucretia, wife of Charles Broadwater, indicating Major Bird had no sons (Whitelaw, pp. 1206 and 1207). On 31 March 1774, Elizabeth Bird, Charles Broadwater and Lucretia, his wife, brought a suit against Isaiah Johnson "in ejectment" for 100 acres of land and marsh on Muddy Creek (Orders 1774-1777, p. 119). They lost the suit, suggesting that Major Bird died before he paid for the last 100 acres. On 6 December 1793, a survey was made of 200 acres bordering the north side of Muddy Creek (Surveyors Record No. 1, p. 249). This was divided between Elizabeth Bird and "Custis and Burton". On 24 June 1800, Elizabeth Bird sold John Kelly 12 to 15 acres "situated on Muddy Creek" for 1 pound 16 shillings. This was "marsh land that formerly belonged to Charles Broadwater" (Deeds 1800-1804, p. 6)..

William was born circa 1677 at Accomack Co, VA. William was named in his father's will on 16 December 1682 at Accomack Co, VA. To sons Robert & William plantation at Occahannock, Robert to have 200 acres & William the remainder..2 He lived in lower Accomack County on land bought by his father Bartholomew Mears in 1679 and other acreage acquired later and willed to him by his father. It was in the area of the present day Middlesex and Good Interest Plantation, west of the ridge of the Peninsula (Whitelaw, p. 601). Situated as it was on the headwaters of Occahannock Creek, it was destined in the century ahead to have 3 mills on the land at a time in history when grist and other mills were an important factor in local industry. The name William Mears appeared on the Accomack County Tithable List in 1692 and on the Quit Rent Roll of 1704.3 He married Mary (-----) circa 1700.4 William was named in his mother's will on 28 July 1703 at Accomack Co, VA.5 William bought land in 1709 at Accomack Co, VA. He had purchased the 200 acres of land his father left his brother Robert in 1709, then owning the entire 355 acres (Acc Co Wills Etc., 1692-1715, part 2, p. 427).. William witnessed a will on 3 May 1717 at Northampton Co, VA. It was on this date that William (an unknown value) Mears along with Daniel Eshon Sr. and Athur Laylor witnessed the will of John Lawrence..6 He made a will on 16 June 1744 at Accomack Co, VA. He was shown as William Meers, planter. To son Bartholomew plantation where he now lives containing 150 acres reversion to his son Elijah Meers, & for want of heirs to my son Elisha Meers. Also my largest oval table. To son William Meers plantation where I now live containing 150 acres. To son Richard 150 acres purchased of Thomas Window. To son Elisha 130 acres adjacent his brother Richard. To daughter Mary Bird. To daughter Elizabeth Stringer. Balance of estate to wife Mary during her life. To sons William, Richard and Elisha my still and head adn worm and my moveable goods to my wife Mary during her widowhood. Wife & son William Exrs. In his will, signed 2 Nov 1803, Nathaniel Bird named: a wife, Naomi; sons, Parker Bird, Daniel Bird and Johnhannes Bird; daughters, Rachel Bird, Naomi Bird, Elizabeth Trador and Rebecca Bloxom; and grandsons, Colly Bird and Custis Bird. Some of his land adjoined John Bird, Nath. Bird Junr., Tosia Johnson Senr., and was land Selby Bird bought. Executors were sons Parker Bird and Johannis Bird. Witnesses were Arthur Watson, Thomas Kelly, Susan Bloxom, and Ezekiel Harmon. Securities for the bond to probate were John Riley and Samuel Johnson (Acc Co Wills&c, 1800-04, p. 709). It was ordered on 30 Jun 1804 that Bennett Mason, Arthur Watson and Isaiah Johnson Senr. or any two of them do audit and settle the estate of Nath. Bird dec'd. and make return (Acc Orders 1804-05, p. 59). Nathaniel was born circa 1725 at Accomack Co, VA.2 He married Naomi Watson circa 1762.3,4 Nathaniel was living at Muddy Creek, Acc Co, VA.3 Nathaniel died in November 1803 at Muddy Creek, Acc Co, VA.5 Nathaniel's will was probated on 26 November 1803 at Accomack Co, VA.5

Bird (Naomi's son) and the heirs of Parker Solomon Bird (Naomi's dec'd son), also all the remainder income from other interests that may come. The executor was son-in-law, Southy Northam. Watson), Nathaniel Bird (land bought from Dennis Kelly); 6 daughters, Nancy Bird, Henny Bird, Harriet Bird, Tabitha Trador, Peggy Kelly and Sally Duncan. He also freed a slave, Peter. Executors were friend Southy Northam and son, Major Bird. Witnesses were Daniel T. Bird, Meshack Duncan and Southy Northam. Securities for the bond to probate were Edm'd Duncan, Daniel T. Bird and Erastus Poulson (Acc Co Wills&c, 1814-16, p. 391). Major was born circa 1763 at Muddy Creek, Acc Co, VA. He married Anne 'Nancy' Watson, daughter of Benjamin T. Watson, circa 1783.2,3 Major died in February 1816.4 Major's will was probated on 26 February 1816 at Accomack Co, VA.4

Selby died in December 1802.4 Selby's will was probated on 27 December 1802 at Accomack Co, VA.4

William was born circa 1770 at Muddy Creek, Acc Co, VA.1 He married Keziah Hinman (Kelly?) on 7 January 1792 at Accomack Co, VA. He was shown as William Bird and she as Caziah Hinman. No other information was given..2 In the 1800 census, William Bird was designated as William Bird, J, aged 26 to 45 years, with a wife of the same age, and a son under 10 years. There was one other male in the household. William Bird owned two slaves in 1800. On 29 December 1800, William Bird bought 60 acres of land "at head of Muddy Creek", from Jacob Bloxom for 290 pounds (Deeds 1800-1804, p. 30).The land was bound on the northwest by the lands of John Riley, on the southwest and southeast by the heirs of Robert Mears, and on the northeast by the heirs of Oliver Bell. Jacob Bloxom had had this land surveyed on 30 October 1800 (Surveyors Record, #3, p. 23 and Whitelaw, p. 1202). It was an odd-shaped tract, bordered on the northwest "by the Bayside road dividing (it) from the lands of John Riley", the southeast portion extending back behind the Robert Mears land. The farm is located southeast of the intersection of present-day routes 658 and 682. It is directly across the road from the southern road to open water at Muddy Creek. A part of the 60 acres was owned by the family until 1905. The 1810 census again gave William Bird as head of a household, aged 26 to 45, with two females of the same age. Apparently his first son was deceased by 1810, for he only had one male in his household, under 10 years. He again owned two slaves. On 2h June 1811, William Bird, Levin Bloxom, and Erastus Poulson bound themselves, by a $1,000 bond, to George W. Smith, Esquire, Lieutenant Governor of the Commonwealth of Virginia, as William Bird was appointed, by the Court of Accomack County, as constable for precinct No. 1, for a two-year period (Deeds 1810-1812, p.286). William Bird was reappointed to this position every succeeding two years until 25 June 1821, when he was last named constable of "precinct of Accomack Parish" for two years (Deeds 1821-1822, p. 553). At this time, Crippen Taylor and Thorogood Taylor Joined him in binding themselves to Thomas M. Randolph, Esquire, Governor of Virginia, for $1500.
The 1820 census listed William Bird as head of a household, aged over 45, with two females over 45 and a son between 10 years and 16 years. He then had three slaves. On 6 July 1822, William Bird bought 43 acres of land from Spencer D. Fletcher for $400 (Deeds 1822-1824, p. 40). The land was bound on the north by lands of William Mason, on the east by the county road running from Muddy Creek to Messongo Bridge, and on the west by lands of Daniel T. Bird. On 4 July 1823, William Bird paid $40 for 11 acres of Abbott Bloxom land (Deeds 1824-1825, p. 148). He was the highest bidder for the land at an auction by James Gillet, Sheriff. No boundaries were given in the deed, but this land was apparently adjacent to his home farm. In his will, William Bird mentioned owning 10 acres Taylor land joining the last purchase, but no record has been found of him buying this or hiring it. Thomas Taylor owned 20 acres of land adjoining William Bird's home farm in 1789 (Deed 1788-1793 p. 259). He made a will on 23 January 1825 at Accomack Co, VA. To Elizabeth Thorns my housman lands called my Bloxom land & 10 acres adjoining the Bloxom land called the Taylor land & at her death or marriage I give these lands to her son James Thorns. To son John Bird my land & house where I now live & my lands I bought of Spencer D. Fletcher & the remainder & if he dies before he arrives to age 21 or he has no lawful issue, then to James Thorns. Witt: Nathaniel S. Topping, Nancy Bird & Griffin Bishop. It is obvious that William Bird's wife, Caziah (Hinman) Bird, was in ill health, for him to have needed a housekeeper and not name her in his will. It is likely she had been unwell since losing a son and the birth of another between 1800 and 1810. This would account for the two females in the William Bird household in 1810, both aged 26 to 45. In 1820, they were both over 4, years. William Bird was seemingly trying to protect his wife, should their only son die, by leaving his property to the Thorns..3 William died in February 1825.3 William's will was probated on 28 February 1825 at Accomack Co, VA. He was shown as John W. Bird and was given 2/3 of the balance of the estate of William Bird..4 John W. Bird's name first appeared in Accomack County records on 27 February 1827, when he was made trustee for his mother. He opposed the proving of his grandfather's will on 1 December 1829. The 1830 census shows him aged 20 to 30, with a wife of the same age and a son under 5 years. There was one other male in his household, likely his cousin George P. Bird, aged 15 to 20. The two older females in the home, aged 50 to 60, appear to have been his mother and her nurse. John W. Bird had 11 slaves in 1830. On 30 June 1831, John W. Bird bought 43 acres from William Mason for $525 (Deeds 1830-1832, p. 212). This land adjoined, on the north, the 43 acre of the Spencer D. Fletcher land he had inherited from his father. The census of 1840 gives both John W. Bird and his wife as 30 to 40 years of age. They had two sons, one under 5 years and one between 10 and 15 years. There were four daughters in the household, all under 15 years, and one other female, aged 70 to 80 years. John W. Bird had 16 slaves in 1840. John W. Bird bought "Jester Land", on 1 July 1846 (Deeds 1846-1848, p. 219). The deed does not give the acreage of this tract, only that he paid $30, that it was the property of Henry Davis, deceased, and was sold at Nock's store. John W. Bird paid $60 for 6 acres on 2 October 1847, which he bought from John Y. Fitchett and wife, land adjacent his home farm (Deeds 1846-1848, p. 578). On 30 October 1848, John W. Bird bought 40 acres from John W. Tunnell and wife Rosetta for $400 (Deeds 1848-1849, p. 366). By 1850, John W. Bird's home place, the 60 acres his father bought in 1800, had grown into a 103-acre farm by additional purchases of surrounding tracts (Surveyors Record ;#7, p. 79). John W. Bird owned the 43 acres his father bought from Spencer D. Fletcher in 1822 (he called this "Fisher land" in his will, it contained a shoemaker's shop), the 43-acre Mason land, the 40-acre Tunnel land, the Jester land and his wife's 66-acre farm. Moreover, there were a number of deeds of mortgage, between 1827 to 1855, in which John W. Bird loaned money and accepted land and/or personal property as security. On 17 January 1843, his uncle ,Eburn Bird owed John W. Bird $1223.33 (Deeds 1842-1843, p. 507). This was cancelled on 31 March 1845 (Deeds 1844-1846, p. 273), but the same day a new mortgage was made by Eburn Bird to a group of people, John W. Bird being one of these (p. 265). This property was released on 27 June 1854 (Deeds 1853-1855, p. 553). John was listed as a head of household in the census of in 1850 at Accomack Parish, Acc Co, VA. He was shown as John W. Bird Sr. the head of HH#1028, a 44 year old farmer with real estate valued at $1,000. Listed with him were the following Birds: Nancy, age 44; George W., a 21 year old laborer; Eveline, age 17; Elizabeth, age 15; Susan, age 12; Littleton M., age 9; Mary, age 7; John W., age 5; Wm. K., age 1 and Nancy, age 75 (who is assumed to be his father's sister). Also listed was Mary Fisher, age 25 and black..5 He made a will on 30 May 1855. John W. Byrd named: a wife, Nancy (land held in her own rite, dower and one negro woman Leah); 4 sons, George W. (land adjoining Edmund Bell, Parker land where George by Riley resides), William R. (under 21, land near school house), Littleton M. (under 21, south end of Fisher land), John O. (under 21, north end of Mason and Fisher land adjoining Custis W. Byrd dec'd, shoemakers shop at store house); 5 daughters, Sarah A. Mason, Eveline Kelly, Susannah Byrd (under 21), Mary Byrd (under 21) and Elizabeth Trader, w/o Samuel Trader. The executors were George W. Byrd and James Mason. Witnesses were Wm. S. Fletcher, Harvey Johnson and S.J. Marshall. Sureties on the bond for probate were George W. Byrd, Richard Mason, John C. Wessells, and Major Mason Senr (Acc Co Wills, 1846-82, p. 260).. John died in 1857.6 John's will was probated on 30 November 1857 at Accomack Co, VA.6 The inventory of John W. Byrd's personal property covers six pages and included nine slaves (Inv. 1856-1861, p. 457). His widow bought most of the household furniture at the sale on 16 December 1857. Among these items were a corner cupboard, six Winds on chairs, and a mahogany table.

Benjamin was born on 1 January 1827 at Accomack Co, VA.2 He married Elitha Ann Northam, daughter of Southy Northam and Naomi 'Neomy' or 'Amy' Byrd, on 24 January 1848 at Accomack Co, VA. Samuel J. Gladding was the security on the M.L.B. of Benjamin W.T. Bird and Ann Northam of Southy..3 Benjamin was listed as a head of household in the census of in 1850 at Accomack Parish, Acc Co, VA. He was shown as Benjamin T.W. Bird the head of HH#618, a 23 year old farmer. Listed with him were Ann Bird, age 32, and Robert Bayly, a 36 year old laborer..4 Benjamin died on 28 May 1885 at Messongo, Acc Co, VA, at age 58. "Homicide at Messongo:" Bennette T.W. Byrd was shot and mortally wounded by Samuel T. Taylor, near Messongo Bridge, this county (Acc), last Thursday morning (Pen. Ent., 30 May 1885). The article explains the circumstant of the shooting. In his will, signed in 1872, Benjamin T.W. Byrd named his mother, Hennie Byrd; wife, Tabitha (Elitha) Ann Byrd; friend, Wm. S. Byrd, who was also the executor. Witnesses were Parker Byrd, Staton F. Byrd and Teackle L. Byrd (Acc Co Wills, 1882-1901, p. 87)..5 His body was interred at Benson Cem, Messongo Bridge, Acc Co, VA.2 Benjamin's will was probated on 29 June 1885 at Accomack Co, VA.1

Custis was born on 3 August 1794 at Muddy Creek, Acc Co, VA.2 He married Keziah Taylor, daughter of Shadrack Taylor and Nancy Lucas, on 28 October 1816 at Accomack Co, VA.3 He married Mary D. 'Polly' Fisher, daughter of John Fairfax Throughgood Fisher and Sallie (-----), on 18 April 1825 at Worcester Co, MD.4 Custis made a will on 20 November 1843. In his will, signed 20 Nov 1843, Custis W. Bird, specified that his sons be raised to the age of 16 years and schooled from the rent of land and slaves and that his daughters be raised to the age of 14 years from the rent of land and slaves. When the youngest daughter reached 14 years, then his bequeaths would take effect. He named sons, Colmore E. Bird, John W.C. Bird, Silvester F. Bird, Odian J. Bird and William A. Bird; daughters, Hetty A. Kelley (one shilling), Drusilla F. Bird, Mary E.C. Bird and Sarah S. Bird; grandsons, Thomas C. Kelly and Elijah Kelly, both under age 21 years. Executors were Colmore S. Bird and William S. Bird. Witnesses were Henry S. Wessells, Littleton T. Bird and Bennet M. Bird. Securities for the bond to probate were David Broadwater and James H. Fletcher (Acc Co Wills&c, 1828-46, p. 515). Custis died on 18 July 1844 at age 49.5 His body was interred at Byrd Plot, Cattail, Acc Co, VA.5 Custis's will was probated on 29 July 1844 at Accomack Co, VA.6
