She was age 20, born in Acc Co and living in Horntown. They were married at John Davis' by I.T. Adkins..4 John died on 19 December 1921 at age 71.2 His body was interred at Downing's Cem, Oak Hall, Acc Co, VA.2

He could have lived somewhere else in England..1 Roger was named as a headright on 16 August 1667 at Accomack Co, VA. Roger Milles was listed as a headright in a land certificate issued to Henry Smith for a 1,000-acre patent on 16 Aug 1667 (Acc Orders, 1666-1670, p. 36).. Deposition of Roger Myles aged about 32 years, 9 Dec 1668: Several times he heard Eliza Carter say that she thought she had a frog or snake in her belly. She said she could go down to Accohannock and get some physic and make either a hog or a dog of it. Signed, Roger Myles. - Court Date 9 Dec 1668. (McKey - V2 p 123 - Accomack Co. Orders 1666 - 1670 p 90). Roger Miles (I) proved by several evidences that he had served his time as servant to Henry Browne, who had not paid him his corn and clothes. Ordered that Browne pay Miles according to the coustom of the country and pay court Charges. Deposition of Daniell Foxcroft aged 42 years, * April 1670: About the middle of March 1667, Foxcroft sold Roger Miles (I) to Henry Brown for 3 years, to be free the First of ApriL. Signed, Daniel Foxcroft. Depostition of Daniell Clanson aged about 34 years, 8 April 1670: Henry Browne said that Roger Miles was free from Mr. Smith (sic) the first of April. He or another Roger Miles, perhaps his son, is a headright in a land certificate issued to James Mills for a 1,500-acre patent on 16 Oct 1673 (Acc Wills, 1673-1676, p. 1).. An Indian named Arthur (attorney: Charles Holden) complained that Roger Miles had detained his gun. Ordered that Miles deliver the gun "sell fixed" to Arthur and pay court costs. (p 133). Court Date 17 Apr 1678. (McKey - V5 p 99 - Accomack Co. Orders 1676 - 1678 p 133). Deposition of Roger Milles aged about 48 years: About last November, Roger was at John Priteman's house at Myssongo, where John Pretteman, Jr. told him about a large white horse, side hobbled with a small cord "and very much galled therewith," Roger advised Prettiman to ride the horse to John Baylie's or some place where he might hear of an owner. Two or three days later when Roger saw Prettiman on the horse at Hunting Creek Mill, he told Prettiman that it was William Anderson's horse. Signed and sworn in open court 3 Jul 1683, by Roger Milles. - Court Date 3 Jul 1683. (McKey - V7 p 24 - (Accomack Co. Orders 1682 - 1690 p 15, 15a). Roger bought land in 1683. Roger Miles purchased 620 acres of land (A116) just south of Gargatha and on the east side of US Route 13 from Miles and Ann Gray in 1683. This was the land patented to Miles Gray in 1672. But two years later Roger and his wife Ann deeded 200 acres back to Ann Gray for her life and then it was to go to her son John Gray.. Roger Miles & Ann now his wife - Deed of Gift - Land formerly belonging to Miles Gray by a patten, Bounded, Bridget Savage, Robt. Davis, Lawerence Robinson - 200 Acres to Ann Gray now wife of Miles Gray and after her death to the reputed son of Miles & Ann Gray. Also, mentioned is the Son & Daughter of Thomas Thomas & Jane his wife, their names Thomas & Enan Robert Thomas - 17 Nov 1685. (Accomack County Wills & Deeds 1676 - 1690 p 408b) This implies that Roger may have another wife named Ann. Roger was named as an heir in October 1686 at Accomack Co, VA. William Smith, in a declaration made in Oct 1686 and recorded 2 Dec 1686, left his whole estate to his cousin Roger Miles with the exception of his land which he left to Roger's son Roger. It was proved by Isaac Dix, age about 42 and Mary Dix, age about 31 (Acc Wills & Deeds, 1676-1690(vi), p. 448).. William Smith died possessed of personal and real estate in the county; in as oral will he gave Roger Miles his personal estate. The will was proved in open court 2 Oct 1686. Miles provided to the court the depositions of Richard Hastings and John Townsend, who declared that the mothers of Smith and Miles were sister born to one mother. Ordered that Miles retain the real estate until a better righ appeared. (p. 107) - Court Date 13 Jan 1686/87 (McKey - V7 p 188 - p107) No connection has been found with Richard Hasting and John Townsend. Lt. CoL. John West sued Roger Miles as executor of William Smith (deceased), producing a note written in 1680, in which Smith had requested West to pay William Benston 4100 lbs tobacco; Smith obliged himself to repay the sum. West, showing the note and receipt, requested and order against Miles, as Smith's executor. After Miles' attorney pleaded a law limiting how far notes are pleadable against the estates of dead men, the court judged that West had not sued within the time allowed. The suit was dismissed. CoL. John West was dissatisfied with the above judgment and requested liberty to appeal to the next general court. This was granted with him and the defendant giving security according to the law. - Court Date 20 Feb 1688/89. (McKey - V7 p 266 - (Accomack Co. Orders 1682 - 1690 p 153a, 154).
Roger Miles and his wife Ann were summoned to court at the suit of Mr. Joseph Robinson against Andrew Steward, and since both of them attended court three days, in was ordered that Robinson pay them 120 lbs tobacco each with court cost - Court Date 15 Dec 1691. (McKey - V8 p 58 - Accomack Co. Orders 1690 - 1697 p 49a, 50). Roger sold land in 1693. In 1693 Roger Miles and his wife Ann deeded 200 acres to Mary Wright. There was no further record of either Roger or Ann Miles, but the balance of the land later was found to be in the possession of a William Miles, who may have been the heir-at-law (Whitelaw, p. 1124). Roger Miles was taxed on 200 acres (VA Hist. Mag., Vol. 34, p. 252). Mr. Tully Robinson petitioned to be paid for serving as a witness for Peter Walker against Roger Miles. Ann was born in 1639 at England.1,2 As of before 16 December 1669,her married name was Wright.3 She married Henry Wright I before 16 December 1669 at Accomack Co, VA.3 It was on this date that Ann Write petitioned to be discharged of her husband's estate. Ann Fooks was named as a headright on 18 November 1671 at Accomack Co, VA. She was shown as Anne Fowke on a certificate granted to Mr. Thomas Fowkes for 650 acres for transporting 13 persons into the colony. (NOTE: She was probably his sister and there was some delay - as was usually the case - in his requesting the certificate.).4 She married Roger Miles (I) circa 1672.5 As of circa 1672,her married name was Miles.5 Ann was named in her brother's will on 10 September 1673 at Accomack Co, VA. Thomas Fowkes left 100 acres of land (Whitelaw tract A118) to a step-granddaughter Amy, the daughter of Robert and Temperance Mason. Amy married an Abbott, and the title passed to a son Mason Abbott. Before the death of Fowkes, there had been some talk of his selling 200 acres to Robert Mason, but no deed was executed; however, the land was claimed by Mason, and after his death title passed to his sister Ann Miles, and then to a son William Miles, who sold to Mason Abbott. (NOTE: Evidently Whitelaw was referring to Fowkes' sister Ann Miles, not Robert Mason's sister, as Fowkes also left another legacy to my sister Ann 'Miells.") Items were also left to a "neafew" Mary Ryle, daughter of Ann, now Ann "Miels", formerly in the possession of Henry Ryle, now in the custody of John Smally..6 Ann was named in her sister-in-law's will on 20 August 1678 at Accomack Co, VA. Thomas Fowkes' wife Amy, requested that her son William Anderson, the executor, see to it that 1,000 L of tobacco be raised out of her estate to be laid out for the best advantage of Mary Right, daughter of Ann "Myles" and of Henry Right deceased. (NOTE: It is assumed that the Mary Wright who Roger and Ann Miles deeded land to in 1693, and the Mary Ryle, daughter of now Ann "Miels" and Henry Ryle in the Thomas Fowkes will of 1674, and Mary Right, daughter of Ann "Myles" and Henry Right deceased in the Amy Fowkes will of 1678 are all the same person with various spelling of the surname. It is also assumed that the Ann Miels/Miells sister of Thomas Fowkes in his will of 1674, and the Ann Myles wife of Henry Right dec'd in the Amy Fowkes will of 1678, and Ann Miles, wife of Roger Miles and mother of William Miles in Whitelaw, p. 1124 and p. 1134 are all the same person.).7 She gave a deposition on 26 May 1679 at Accomack Co, VA. Deposition of Ann Miles aged about 40 years: Ann, "formerly using Mr. Yeo's house", often heard Mr. Yeo say that he had sent for his cousin to make him his heir when he died. After William Yeo came, Mr. Yeo acknowledged him "as his kinsman, calling him cousin." In return, William called Mr. Yeo "uncle." William slept and ate with Mr. Yeo, who continued to say that he sent for William to make him his heir if he died. Signed 26 May 1679, Ann (P) Miles.1,2 She sold land in 1685 at Accomack Co, VA. In 1683 Roger Miles purchased 620 acres of land (Whitelaw tract A116) from Miles and Ann Gray, but two years later he and his wife Ann deeded 200 acres back to Ann Gray for her life and then it was to go to her son John Gray. She deeded land in 1693 at Accomack Co, VA. In 1693 Roger Miles and his wife Ann deeded 200 acres to Mary Wright. The balance of the land was later to be found in the possession of a William Miles, who may have been the heir-at-law (Whitelaw, p. 1124). On 2 Jun 1708 in Accomack County Court, Mary Right, who had been presented for having a bastard child, was summoned to this court. When her mother informed the court that Mary was weak and unable to come, they ordered that she appear at the next court.8 Ann died before 1712 at Accomack Co, VA. Roger was born circa 1672 at Accomack Co, VA. Roger was named as an heir in October 1686 at Accomack Co, VA. William Smith, in his will made Oct 1686 and probated 2 Dec 1686, left to cousin Roger Miles his whole estate with the exception of his land which he left to his son Roger Miles. It was proved by Isaac Dix, age about 42 and Mary Dix, age about 31 (Acc Co Wills & Deeds, 1676-1690(vi), p. 43).. At a court held 8 September 1701, it was ordered that Mr. George Parker, Sr., (surveyor of the Sea Side) take some residents .... Roger Miles and other went with Mr. Parker and view the road. - Court Date 6 Oct 1702. (McKey - V9 p 143 - Accomack Co. Orders 1697 - 1703 p 130a). Roger witnessed a will on 18 May 1708 at Accomack Co, VA. It was on this date that Roger Miles, Thomas Crippen and William Miles witnessed the will of Charles Champleshon, mariner. Richard Kitson was named guardian on his son Charles (under age). The will of Charles Campleshon, was proved by the oath of Roger Miles and William Miles and by the testimony of Thomas Crippin, a Quaker (p. 123) - Court Date 5 Oct 1709. It is thought that he married a Paker, since one of his grandsons was named Parker Miles and that name was used by his descendants for many generations. William bought land in 1712 at Accomack Co, VA. It was in this year that William Miles bought 135 acres from tract A115. The William Hickman part seems to have been the northeast corner of the tract. In 1707 William Hickman sold his 135 acres to Charles Fonelson and in 1712 he and his wife Ann sold to William Miles and it became merged with a part of A116. Cha. Venelson presented and acknowledged a deed for land he sold to William Miles. Ann the wife of Cha. Venelson acknowledged her relinquishment of dower to the land her husband sold to Wm. Miles. Court date 7 Jun 1726. (Orders Accomack Co. 1724 - 1731 p 56a). The following is from Mrs. Turman's report on the Miles family. "On 24 July 1727, William Miles deeded 150 acres to his son William. He bought some adjoining land to add to that owned by Roger and Ann. On 26 Jan 1742 William Miles deeded 185 acres to Roger Miles, his eldest son. Since no wife released her dower, it is concluded that she was deceased before 1742. William Miles died intestate after 1744 [based on being mentioned in his son Roger's will of 1744] and his administration was not found. It appears that he lived at the place given his son Roger until his death. (Orders Accomack Co. 1724 - 1731 p 116). William deeded land as a gift on 3 February 1735 at Accomack Co, VA. On 3 Feb 1735, years after William Miles gave "Deed of Gift" 150 acres at the south end to his son William, a balance of 185 acres was given to a son Roger. Williams and wife Ester sold 150 Acres to John Major in 1735. (Accomack Co. Deeds & Wills 1729 - 1737 p 484 & 485). William sold land on 25 January 1741 at Accomack Co, VA. Roger was born circa 1700 at Accomack Co, VA.2 Roger Miles at Massongo's his Mark of Cattle &c is a Flower de Luce on ye. Right ear & a Swallow Fork on the left ear which at the desire of the said Roger Miles is admitted to record May the 14th 1728 (Accomack Co. Will, deed Etc. 1715 - 1729 p214. He married Elizabeth Bayly, daughter of Maj. Richard Bayly (II) and Elizabeth Lacy?, circa 1728 at Accomack Co, VA. Roger married Elizabeth Smith, widow of Valentine Smith, probably before May 1728. Elizabeth had one son, Bayly Smith, who eventually inherited his parents' land, but it appears that Roger and Elizabeth reared their family there. On 11 Feb 1724 Richard Bayly (possible father of Elizabeth) had assigned to Elizabeth Smith and Valentine Smith, her husband for L100 current money a 300-acre tract of land on the south side of Messongo Creek. The land was entailed in that Valentine was to have a life interest if his wife predeceased him. The land was to go to the lawful heirs of their "body." Elizabeth was not mentioned in the will of said Richard Bayly so the relationship was not established. The date of Valentine's death was not determined, but his administration was not granted to Roger Miles until 5 Oct 1731. Other dates 3 Jun 1729, 2 Jul 1729, 6 Aug 1729 6 May 1730, 4 Aug 1730, 8 Oct 1730, 4 Nov 1730, Decision in favor of Roger Miles. (Orders Accomack Co. 1724 - 1731 p 144a). He served on a jury in 1729 at Accomack Co, VA. Roger Miles on jury several times: 2 Sep 1729, 3 Nov 1730, 4 Nov 1730, 1 Jun 1731. (Orders Accomack Co. 1724 - 1731). On 5 Oct 1731 Roger Miles was named to settle the estate of Valentine Smith.5 On 1 Jun 1736 it was ordered that Roger Miles and Ann Parker be summoned to next Court to answer the information of the churchwardens for incontinent living and that Thos Fletcher, Susannah Michaele, John Dear and Mary Brymer be summoned to give Evideance on behalf of churchwardens aforesaid (Accomack Co. Orders - 1731 - 1736 p 185). In the imformation brought by the churchwardens of this Parish against Roger Miles & Ann Parker for incontinent Living, the Evedience being examined & Argument heard it did not appear the the aforesaid Roger & Ann were guilty Therefore they are ordered to be discharged - 7 Jul 1736 (Accomack Co. Orders - 1731 - 1737 p 189).
On 29 May 1739 it was ordered Roger Miles be appointed Surveyor of the Roads in the Room of Walter Warrington (Accomack Co. Orders - 1737 - 1744 p 148). He made a will on 25 January 1744 at Accomack Co, VA. Nottingham's abstract: To son William Miles the plantation were my father now lives containing 180 acres. Son-in-law (meaning step-son in today terminology) Baley Smith. Wife (no name) & children residual legatees. Friend Henry Fletcher Extr. Witt: John Hall, Timothy Donoho and Elizabeth Brymer. From Turman: He left to son William "plantation where my father lives containing 180 acres." To son-in-law Bayly Smith, his inheritance. The term meant step-son at that time and a court order regarding the settlement of Roger's estate referred to Bayly as the heir of Valentine Smith. Wife and children residue of estate. The estate was divided without a sale. The inventory and appraisal were returned to the court 28 Aug 1744 and the report of division and audit were returned to the court 29 Aug 1745. After the widow's part was taken out and that of Bayly Smith paid, each child got L8-9-3. That is 8 pounds, 9 shillings 3 pence current money. Son William was under age. Elizabeth was born circa 1700 at Accomack Co, VA.2 She married Valentine Smith circa 1724 at Accomack Co, VA.3,1 Elizabeth bought land on 11 February 1725 at Accomack Co, VA. According to the Turman research, it was on this date that Richard Bayly had assigned to Elizabeth Smith and Valentine Smith, her husband for L100 current money a 300 acre tract of land on the south side of Messongo Creek. The land was entailed in that Valentine was to have a life interest if his wife predeceased him. The land was to go to the lawful heirs of their body. Since Elizabeth was not named in the will of said Richard Bayly, the relationsip was not established. According to Whitelaw, Richard Bayly deeded the eastern 300 acres entailed to Elizabeth and Valentine Smith; the later died intestate in 1731 and his estate was administered to Roger Miles, who may have married Elizabeth, but a son Bayly Smith was the heir-at-law. In 1797 Bayly Smith (wife Elizabeth) left 100 acres each to his sons Spencer and Ralph and the balance to son Zorallingtine (Valentine?). A survey ten years later revealed that his was the eastern part of the whole tract, and that the last-named son received 197 acres, which included a small creek frontage and a little above the road, while the other two sons' lands were above him, with Spencer's part to the eastward. (Note: This land is in the present area know as Marsh Market on Messongo Creek.).3,4 She married Roger Miles (III), son of William Miles (I) and (-----) Parker (Parker?), circa 1728 at Accomack Co, VA. It was on this date that William Miles Jr. sold John Major for 30 Pounds, land which my father William Miles gave me by Deed of Gift & Acknowledged the same in open court 4 Day of July 1727. Deeds & Wills 1729 - 1737 p 484 & 485) The deed reads as follows: In all Christian People to whom these presents shall come Greeting Know yee that I William Miles junr of the County of Accomack in Virginia for divera causes & Considerations me thereto moving but more especially for & in consideration of thirty pounds whereof thirteen pounds ten shillings to be paid in Tobacco & Cask the remainder to be payd in Country pay at Country prices as usual to me in hand payd & secured before the perfection hereof by John Major of the same County planter have bargained Sold & Confirmed delivered & Assign's & set over likeas by these presents I do bargain Alien Sell Conform & deliver Assign & set over to the said John Major his heirs executors, Administrators & Assigns for ever one hundred & fifty acres of Land which said Land my father William Miles gave me by Deed of Gift & Acknowledged the same in open court as his act & Deed the 4th day of July 1727/ & bounded as followeth making the first bounder on Silbs Onions Land on the southeast being the Land formerly belonging to Cap t Daniel Jennifer beginning at the aforesaid Onions Land so running a Line of Marked trees Northwest across my Land to Joseph Hickman Land & Southerly bendeth upon William Hickmans Land & the Land formerly Charles Camtisons Land & so to the first bounder on Onions Land aforesaid &c. The following is from Mrs. Turman's report on the Miles family. "William Miles, son of Roger and Elizabeth, was a minor when his father died in 1744. Since his mother was living, it was not necessary for him to have a guardian when such a small amount of cash was involved. No administration for his mother was found. William's first wife's name has not been found and only circumstantial evidence shows that the wife who survived him was Polly. The following was taken from another part of Ms. Turman's report. -- "William Miles, lineal ancestor of Darius appears to be the "William of Pocomoke" listed in the 1800 Census and he was the son of a Miles who died intestate circa 1764 (?) (probably typo - 1744). He is not the William who served in the Virginia Navy during the Revolutionary War. The inventory taken 9 Apr 1817, and report of settlement of estate returned to court 31 Jan 1825 names no heirs. The identified son of William was David Miles who married Margaret." He was named as son William Miles and left 180 acres in the will of Roger Miles..3 William was named as an heir on 29 August 1745 at Accomack Co, VA. Also listed were 1 free Negro and 1 slave..4 William died in March 1817 at Accomack Co, VA.5 Administration of William's estate was filed on 31 March 1817 at Accomack Co, VA. It was on this date that David Watts was named to settle the estate of William Miles. It was on this date that a deed from Rachel Miles to George Miles was partly proved by the oath of James Ailworth a witness thereto. On 29 Jul 1811, it was fully proved by the oath of Robert Hickman and William W. Burton (Acc Orders, 1809-1811, p. 275).. Rachel was named in a land cause on 27 November 1816 at Accomack Co, VA. Rachel Miles, mother of Ralph Justice, was involved in a partition suit. This was a partition suit with William Justice, Jr., Samuel Justice, William White & Nancy, his wife, Rachel Miles, Obed Adams & Anna, his wife, Robert P. Broadwater & Sally his wife, Amey Rowley and Richard Nock vs. Polly, Anna & Tabitha Justice, infants. It reveals that Rachel's first husband, Richard Justice, died and that Thomas Justice, one of their sons, destroyed his father's will because he was not included in it. In rectifying the situation, all the heirs of Richard Justice and Rachel are identified..6 She made a will on 25 June 1818 at Accomack Co, VA. She was shown as Rachel Miles, widow of Roger Miles. To son William Justice ... To son Samuel A. Justice timber to repair his dwelling house & to build a kitchen & barn on his land if done in his lifetime. To granddaughters Peggy & Esther White ... To granddaughters Polly Justice, Ann Justice & Tabitha Justice ... & 27 acres adjoining the lands of William Justice, Richard Bloxom & Breachy Broadwater. Brother Richard Wimbrough & son Samuel A. Justice Extrs. Witt: Jacob Warner, Solomon Warner & William Gardner. The following is from Ms. Turman's Miles Family report. -- "David Miles, son of William, was married when the 1800 Census was taken and a notation identified him as the son of William. He was under 26 years of age and there were one male under 5 and two females, one under 26 and another between 26 and 45 years of age in his household. The next reference to David Miles was 29 Dec 1806, when he was security for the marriage of Savage Broadwater to Nancy Broadwater. "Daivd married Margaret whose last name was not found. She died before 1824, when David sold his livestock and some household furniture. From the members of his household in the 1800 Census, it appears that David and Margaret had other children, but only one son has been identifed. No record of an administration has been found for David to date. It appears that James became a successful business man and money lender at an early age. He purchased several tracts of land which he deeded to his sons, but retained a life interest in some of them. James P. and Margaret were the parents of five sons as shown in the 1850 Census and four lived to marry and rear families. The date of Margaret's death was not found, but the second wife of James P. was Nancy in the 1880 Census. James P. made his will in August 1889 with no day indicated. It was probated 30 Dec 1889. The record of his death filed by son Alfred shows that he died 20 Nov 1889, age 84 years, and that record states that he was the son of David and Margaret Miles. (Roger Miles Descendants by Mrs. Turman: Sources: Acc Co Marriages; Acc Co Deeds from 1849; Acc Co Wills, 1882-1901, p167; Acc Co Reg of Deaths, Bk 2, July 1871 - Dec 1896, entry no. 89 for year 1889). Tombstone records shows him as James "F" Miles, but the since the stone is over 100 years old, the "P" could have faded and looks like and "F". In a deed dated 12 Aug 1859, James P. Miles and Margaret his wife sold 60 acres to James H. Fletcher for $700, bounded on the north by Charlotte and Ann Broadwater, on the east by J.H. Fletcher, on the south by Robert Chasser, and on the west by James H. Fletcher (Acc Deeds No. 42, 1858-1860, p. 524). James was born on 13 November 1805 at Accomack Co, VA.2 He married Elizabeth Barnes on 4 January 1832 at Accomack Co, VA. Elijah Miles and Elijah Hinman were the securities on the M.L.B. of James Miles and Elizabeth Barnes..3 He married Margaret 'Peggy' Broadwater, daughter of Savage Broadwater and Nancy Broadwater, on 26 March 1838 at Accomack Co, VA. There were no free white males listed. Free white females included only 1 between age 50 and 60, implying that Comfort was born 1770-80. The ranges of these three births: 1755-74, before 1765, and 1770-80 do not have a common overlay between them.
