It was on this date that James Garrison & Hutchinson Kellam witnessed the will of Thomas Bell.2 Hutchinson witnessed a will on 21 June 1796 at Accomack Co, VA. It was on this date that John Teackle Jr., John Arlington & Hutchinson Kellam witnessed the will of Leah Seymour, mother of John Revell & Wm. Seymour.3 He married (-----) (-----) circa 1800. Hutchinson was named as administrator of an estate on 27 October 1807 at Accomack Co, VA. It was on this date that administration on the estate of Gilbert Milby was granted to Hutchinson Kellam with Jesse Ames & George Smith securities.4 He sold land in 1810 at Accomack Co, VA. In 1810 when Hutchinson Kellam and his wife Sarah sold their part of tract A5 (between Belle Haven & Quinby) to George S. Savage, the deed incuded another 175 acres, which must have been the original John Savage third of the tract. In that deed Hutchinson and Sarah Kellam were joined by other Kellam heirs: Custis Kellam, femme sole, and Betsy Milby, widow of Gilbert Milby; it recited that the land had belonged to their grandmother and had descended to them upon the death of their father John Kellam in 1785. Unfortunately, neither the name of the grandmother nor the first name of her husband was given, but possibly she had been the sole heir of the John Savage who had inherited this part in 1717 from his father Roland Savage. (Note: An indepth look into this relationship shows that John Savage named 3 young chirldren in his will of 1728: Charles, Patience and Mary. The John Kellam, who died in 1785, was the son of Joseph and Patience Kellam, thus this Patience, mother of John Kellam, was certainly the daughter named in the will of 1728.).5 Hutchinson was named as administrator of an estate on 25 March 1811 at Accomack Co, VA. It was on this date that administration on the estate of Custis Kellam Jr. was granted to Hutchinson Kellam with Isaac Dunton & Levin S. Joynes securities.6 He bought land in 1812 at Accomack Co, VA. It was in this year that Hutchinson Kellam bought the Jean Hall part of tract A25 (on Nassawadox River) from Richard & Jane Read.7 He married Elizabeth Milby, daughter of John Milby, 14 Sep 1814 (bond) at Accomack Co, VA. Henry S. Copes was the security on the M.L.B. of Hutchinson Kellam and Elizabeth Milby, orphan of John.8 On 8 Jan 1817 Hutchinson Kellam was shown as a buyer at the estate sale of George Kellam.9 Hutchinson Kellam sold land in 1827 at Accomack Co, VA. It was in this year that Hutchinson Kellam and his wife Elizabeth sold the Jean Hall part of tract A25 (on Nassawadox River) to John Phillips.7

Charles Scarburgh

Charles was born circa 1625 at England. According to Ralph Whitelaw, the identity of Charles is an unsolved problem. Some historians have identified him with Charles the son of Colonel Edmund, but such a solution is contrary to fact, as in 1654 the latter was only eleven years old and supposedly was then in England for his education. It is possible that this unidentified Charles was a nephew or first cousin of Colonel Edmund. His first appearance in the county records was in the year before the marriage agreement, when he made a deposition. No record has been found to indicate that this Charles ever had a home of his own; in 1656 a reference to him said "att his nowe dwellinge howse at Nuswattocks," so perhaps he and his wife lived with her mother Mrs. Ann Charlton. In 1657, when apparently about to take a voyage, he set John Coale free from service, in case he should not return within 12 months. Nothing more concerning Charles appeared in the local records until August, 1663, when a reference was made to the estate of Henry Scarburgh (son of Charles and Katherine), and describing him as "the son of Mr. Charles Scarborough in England," so he may have remained abroad until 1664, when he again appears in the Accomack records, and there both he and his son usually had their names written out in the full original spelling. (Note: There is more on Charles in Whitelaw, pages 656 and 657.). He married Anne West, daughter of Anthony (1) West and Anne (-----), circa 1650.1 Charles Scarburgh took the oath of allegiance to hereby engage and promise to be true and faithful to the Commonwealth of England as it is now established without King or House of Lords on 30 March 1651 at Northampton Co, VA. He was shown as Charles Scarburgh.2 He married Katherine (3) West, daughter of Anthony (1) West and Anne (-----), on 27 May 1654. Charles Scarburgh married Kathryne the sister of John West (formerly the wife of Ralph Barlow). Their marital agreement is at N'hamp Deeds, Wills, etc., 1655-1657, f. 20. A Charles Scarburgh, gentleman, made a marriage agreement with Katherine Barlow whereby she was to keep her cattle on the plantation of her brother John West..3,4,5,6 Charles died before 17 May 1681. In a lawsuit it was brought out that Edmund Bowman had married the executrix of Mrs. Ann Charleton, deceased. Charles' wife Katherine would have been the executrix..7

Richard was born circa 1660 at Accomack Co, VA. He was security on the administration of an estate on 17 November 1685 at Accomack Co, VA. It was on this date that administration on the estate of William Smith was granted to Leonard Goring with Richard Kellam Sr. & Richard Kellam Jr. securities.2 He received land as a gift on 9 January 1686 at Occahannock Creek, Acc Co, VA. It was on this date that Richard Kellam Senr of Accomack gave to his son Richard Kellam Jr. of same place, 500 acres upon Occahannock Creek for his use, and entailed to such of his male issue as he Richard Jr. shall deem fitting to receive it, failing such issue then to sons Edward, William, daughter Katherine Taylor, daughter Ann Kellam (later Wallis), daughter Rachel Lingo, successively. Richard Senr & wife Sarah to have use for life.3 Richard was named as an heir on 29 January 1686/87 at Matchepungo Creek, Acc Co, VA. It was on this date that Richard Kellam Sr. made a deed of gift (D.G.) of 300 acres on Matchepungo Creek to his son William Kellam. It began at the mouth of Beaver Dam Branch over against that point of land where Francis Roberts now lives, together with the plantation where the said William Kellam now lives, and for want of heirs to sons Richard and Edward to be equally divided between them and for want of heirs to grandson Henry Turner, reserving to himself and wife Sarah Kellam the use of the lands for life.3 He deeded land in 1695 at Quinby-Wachapreague, Acc Co, VA. It was in this year that Richard Kellam Jr. gave his 250-acre part of tract A42 (between Quinby & Wachapreague) to his son Richard III. Then in 1723 Richard Kellam III sold 50 acres to William Lingo and 1731 gave the 200-acre balance to his son West Kellam. (NOTE: Whitelaw evidently confused the Richard Kellams, as it was Richard Kellam II (wife Frances West) who died in 1731, not Richard Kellam III.).4 He married Frances (12) West, daughter of Lt. Col. John (2) West and Matilda [13] Scarburgh (Quaker), circa 1695 at Accomack Co, VA.5,6 Richard Kellam II received land as a gift in 1697 at Sarah's Neck (Craddock Neck), Acc Co, VA. It was in this year that Col. John West gave land in Sarah's Neck, now called Craddock Neck, to his daughter Frances and her husband Richard Kellam Jr. They moved from Occahonnock Neck to this land.7 Richard was named in his father's will on 1 June 1703 at Accomack Co, VA. He was shown as a son Richard Kellam and given 5 schilling in the will of Richard Kellam..8 He patented land on 1 February 1703/4 at Accomack Co, VA. He was shown as Richard Kellam on a certificate granted for 800 aces for transporting 16 persons into the colony.9 He deeded land as a gift in 1731 at Accomack Co, VA. It was in this year that Richard Kellam II gave 200 acres of his part of tract A15 (on the north side Occohannock Creek) to his son William; it was the southern part of the remaining 400 acres and was called "Clems." In 1770 William Kellam (wife Sarah) left to his son Benston and then to a grandson William; the latter died intestate and title went to his daughter Nancy, who in 1799 married Armistead Mears. While it was no traced further, this land perhaps was the part north of the crossroad, show by the survey in 1820 of the land of George Kellam belonging to A15B. Also in 1731 Richard Kellam II (wife Frances West) left the remaining 200 acres to his daughter Catherine. Then in 1738 Aaron and Catharine Acar sold 50 acres in the northwest corner to Dormon Siluent. He left no will but seems to have been succeded by a son Daniel, and in 1798 Daniel Sullivan left to his son William. In 1803 processioning records gave the owner as Susanna Sullivan, beyone which point it was not traced. In Aaron and Catharine Acar sold the remaining 150 acres to Jeodiah Bell, and the next year he and his wife Sarah Bell resold to Jonathan Kellam, who was a son of Richard Kellam II.10 He made a will on 8 February 1730/31 at Accomack Co, VA. To daughter Catherine 200 acres adjcent my son William's land & for want of heirs to my son William. To daughter Sarah Sill 100 acres at the head of Sarah's Neck adjcent John Sill's land. To son Jonathan Kellam. To son Richard. Bal. of estate to wife Frances during her widow, then to be divided between 4 of my children, Sarah Sill, William, Jonathan & Catherine. Wife Exec. Richard was born in 1619 at England.2 Richard Kellum the 1st, came to Virginia on "The Promise" of which Captain Douglas was Commander. At the clearage of the ship at Gravesend, England, 27 Jul 1635, he was entered as a passanger and 16 years old.2 He married Sarah Ansley circa 1649.3,4 Richard Kellam I patented land on 28 July 1649 at Northampton Co, VA. A certificate is this day granted unto Rich: Kellum for 300 acres of land at Occahannock Cr, being a neck of land bounded on the South by the main Creek, due him for transporting the following 6 persons: Sarah Ainsley, Ann Corbett, Mary Kinge, Jno Thomson, Henry Worsley & Isaacke Emersley (Hemersley).2 He took the oath of allegiance to hereby engage and promise to be true and faithful to the Commonwealth of England as it is now established without King or House of Lords on 30 March 1651 at Northampton Co, VA. He was shown as Richard Kellam.5 In 1655 an Act of Assembly provided that courts were to be held at two places alternately, with Hungars Creek to be the dividing line for the uppper and lower parts. However, a later Act stipulated that one plance in each county should be designate, where the court, church, prison, and a public mart should be maintained; the inhabitants chose the land of Richard Kellam (A15A) and courts seem to have been held there for the next few years.6 He patented land in 1662 at Wachapreague-Quinby, Acc Co, VA. The original patent was to John Evans in 1661, which he and his wife Joane, sold to Richard Kellam. In 1662 a patent was issued to Richard Kellam for 400 additional acres and 2 years later another patent to him for 900 more acres. In 1672 another patent was issued to Richard Kellam for 1,850 acres to include all of the above and 150 acres surplus found within the bounds. That patent was reissued the next year.7 On 23 May 1663 Richard Kellum admitted killing Richard Buckland's cow and was ordered to pay a fine of 1000 lbs tobacco and to pay Buckland 1000 lbs tobacco and a new cow. Kellum was to remain in the sheriff's custody till posting a bond for good behavior and paying court costs. The jury considered the difference between Buckland and Kellum and found the cow called Butterflower to be Buckland's. The jury, sent out again, considered Kellum's confession and found it to be a matter of fact. Deposition of John Jenkins, 22 May 1663: Two years ago last March Jenkins accompanied Buckland to Kellum's, and Kellum asked what Buckland would charge to teach his daughter to write, figure, and knit. Buckland asked for a cow and calf, to which Kellum agreed. About a month later the cow, Butterflower, and a calf was brought to Buckland by John Burt, Kellum's servant. Deposition of Daniell Dorman aged about 22 years, 22 May 1663: Because he was at William Bosman's to "fetch guns home" that day, he knows nothing of the matter. Signed, Daniel (CC) Dorman. Deposition of Dorothy Churchill aged about 20 years, 23 May 1663: Dorothy was in the cowpen when Buckland came in and she knew of no sale or bargain or of any delivery of a cow by her master to anyone. Deposition of John Burt aged about 24 years, 22 May 1663: "I never knew Richard Kellum to deliver a cow and calf to Richard Buckland or ever sell him one." Signed, John Burt. Deposition of Richard Welch aged about 19 years, 22 May 1663: Said the same as John Burt. Signed, Richd. (e) Welch.8 On 17 Dec 1663 Richard Kellum sued Richard Buckland over a cow formerly in controversy. The court considered Kellum's petition, his evidence, and Buckland's answer, and ordered that there was no cause to overturn the verdict given by a jury last May. Kellum's suit was dismissed with him paying court charges. Evidence for Rich. Kellum: Deposition of Oneal Dermon aged about 25 years, 11 November 1663: Said that he was at last May's court after judgment was passed against Richard Kellum for killing a cow, and heard Kellum's wife and Rich. Buckland discussing the cow. Buckland declared, and bound it with an oath, that he gave Kellum permission to kill the cow in question. Signed, Oneale (C) Derman. Deposition of Edward Martine, 11 November 1663: On 19 June 1663, Martin was with Richard Kellum's wife Sarah at Richard Buckland's house, where he heard Sarah demand a bill from Buckland for seven and a half bushels of wheat. Buckland called her impudent and told her that John Jenkins could swear that he had the wheat for the cow in question. Buckland said that Kellum sent his girl to say that Kellum would kill the cow, and Buckland said her father could kill the cow if he provided another for it. Buckland said to Sarah, "Country woman, if you will be peaceable, I will tell you the bargain." The bargain was made at night in the inner room in the chimney corner with nobody around except for Buckland's namesake, who had advised Buckland to get a good milk cow and allotted Buckland a black pied cow. The next morning Buckland went to his namesake, the cowkeeper, and asked which was the best cow, for "your master saith I must have a cow called by the name of Py." The boy said that wasn't a good cow, so Buckland asked if the boy could point out the best one, and the boy replied, "What will you give me?" Buckland agreed to give him six pipes. Deposition of John Die aged about 36 years, 11 November 1663: Said that Richard Buckland sent for Sara Turnor as soon as judgment was passed and asked, "Sara, did you tell me that your father would kill the cow named Butterflower?" She answered yes and also admitted that her father would give Buckland another one. Then Buckland bound it with an oath and swore it was the truth and said it was not yet paid. Sara said he might have had it if he had come for it. John (I) Die. Deposition of Richard Stevens, 16 December 1663: Said that on 19 June 1663, he was with Richard Kellum's wife Sarah at Richard Buckland's house, where he heard Sarah demand a bill from Buckland for some wheat. He replied, "Are you so impudent to demand a bill of me for wheat? Look upon the records and on John Jenkins' oath, and there you shall see what I had the wheat for." Concerning the cow, Buckland said that he borrowed Capt. Parker's horse to fetch the cow home. Goody Kellum asked if it was a black pied cow, and Buckland said he thought it was, and said that he bargained with her husband over night. The next morning he went to the cowpen and asked Richard Welch which was the best cow. Signed, Richard Stevens. Deposition of Sarah Turnor, aged about 14 years, 11 November 1663: Said she was sent to Richard Buckland's to tell him that her father intended to kill the cow called Butterflower because she was barren, and that her father would give him a pregnant cow or a cow with a calf in exchange. Buckland said a pregnant cow would do him no good, because it would run away, but he would be content with a cow and calf. Signed, Sarah Turnner. Evidence for Buckland: Deposition of Christopher Calvert, aged about 48 years, 16 December 1663: About the beginning of last May he heard Richard Buckland demand to know from Richard Kellum how Buckland's cow was doing. Kellum replied, "It is well." The next morning at Kellum's house, Buckland asked Kellum if he had considered what they had discussed last night. Kellum replied, "I will deliver you a heifer with calf or a calf by her side, provided you will have nothing to do with the heifer that I have of yours at my pen." Signed, Christopher (+) Calvert.9 He patented land on 19 July 1664 at Accomack Co, VA. He was shown as Richard Kellam on a certificated granted for 900 acres for transporting some 18 persons into the colony, including Sarah Amsley, John Kellam, Edward Bird & others.10 He patented land on 16 July 1666 at Accomack Co, VA. He was shown as Richard Kellam and granted a certificate for 350 acres for transporting 7 persons.11 On 17 Mar 1669/70 Richard Kellam and Edward Hammond differed over a small tract of land lying between them at Matchepungo. At the court's proposal, Hammond chose John Stokely and Kellam chose Nathaniel Bradford to determine the value of the work done on the land; Kellam would pay that sum to Hammond, who was to transfer ownership to Kellam. If they did not agree, the order was void, and the first prosecutor would pay the charges. If they agreed, the court charges could be shared equally.12 He patented land on 7 March 1671/72 at Accomack Co, VA. He was shown as Richard Kellam on a certificate granted for 200 aces for transporting 4 persons into the colony.13 He patented land on 17 July 1672 at Accomack Co, VA. He was shown as Richard Kellam on a certificate granted for 350 aces for transporting 7 persons into the colony.14 On 18 Jun 1673 Richard Kellam of the upper part of Northampton Co, for natural love & affection to my daughter Rose Kellam alias Armitrading, wife of Arch. Armitrading of county aforsaid, I assign & set over to my son Richard Kellam Jnr. one mare branded with RK etc. for the the use and benefit of said daughter Rose. Witt: Sarah Turner, Katherine (K.K.) Kellum & Jno. Tankard.15 He was security on the administration of an estate on 17 November 1685 at Accomack Co, VA. It was on this date that administration on the estate of William Smith was granted to Leonard Goring with Richard Kellam Sr. & Richard Kellam Jr. securities.16 He deeded land on 9 January 1686 at Occahannock Creek, Acc Co, VA. It was on this date that Richard Kellam Senr of Accomack gave to his son Richard Kellam Jr. of same place, 500 acres upon Occahannock Creek for his use, and entailed to such of his male issue as he Richard Jr. shall deem fitting to receive it, failing such issue then to sons Edward, William, daughter Katherine Taylor, daughter Ann Kellam (later Wallis), daughter Rachel Lingo, successively. Richard Senr & wife Sarah to have use for life.15 He deeded land on 29 January 1686/87 at Matchepungo Creek, Acc, VA. It was on this date that Richard Kellam Sr. executed a Deed of Gift to his son Edward Kellam for 300 acres on Matchepungo Creek, being part of 400 acres fromerly taken up by John Evans, together with the plantation where the said Edward Kellam now lives, to begin at a branch commonly called the Beaver Dam Branch, and for want of heirs to my two sons, Richard and William Kellam to be equally divided between them, and for want of heirs to dau. Rose Garrison, and for want of heirs to dau. Bridget Kellam, alias Savage, reserving to himself and wife Sarah the use of the said lands for life.4 He deeded land on 29 January 1686/87 at Matchepungo Creek, Acc Co, VA. It was on this date that Richard Kellam Sr. made a deed of gift (D.G.) of 300 acres on Matchepungo Creek to his son William Kellam. It began at the mouth of Beaver Dam Branch over against that point of land where Francis Roberts now lives, together with the plantation where the said William Kellam now lives, and for want of heirs to sons Richard and Edward to be equally divided between them and for want of heirs to grandson Henry Turner, reserving to himself and wife Sarah Kellam the use of the lands for life.15 He deeded land on 29 January 1696/97 at Matchepungo Creek, Acc Co, VA. It was on this date that Richard Kellam Sr. gave daughter Rachel Lingo, wife of William Lingo, a deed of gift (D.G.) of 300 acres on Matchepungo Creek for life, then to grandsons Aynesly and William Lingo, sons of Rachel & William Lingo, to be equally divided between them, and for want of heirs to the next male issue of the said Rachel & William Lingo, and for want of such male issue to my son William Kellam, reserving to himself and wife Sarah Kellam the use of the lands for life.4 He made a will on 1 June 1703 at Occahannock, Accomack Co, VA. He was shown as Richard Kellam of Occahannock, being very aged and weake in body. To 2 sons Edward & William Kellam 5 s. each. To daughter Sarah Kellam, now Curle. Daughter Ann Kellam, now Wallis. Daughter Rachel Lingo 5 s. each. To daughter Rose Kellam, now Garretson, 60 acres on Burrells Branch. To godson William Onely, son of Clement Onely. To son William 50 acres adjcent his own land on Beaver dam branch. To son Richard 5 s. Wife Sarah Exec. Witt: Stephen Waltham, William Sill..17,18 Richard died before 6 October 1703 at Accomack Co, VA.17

Sarah was born circa 1634. As of circa 1649,her married name was Kellam.1 She married Richard Kellam I, son of (f/o_Rich) Kellam, circa 1649.1,2 Sarah Ansley was named as a headright on 28 July 1649 at Northampton Co, VA. She was shown as Sarah Ainsley on a cetificate granted to Richard Kellam for 300 acres of land at Occahannock Cr in N'hamp County.3 Sarah was named in her husband's will on 1 June 1703 at Accomack Co, VA. She was shown as a wife Sarah in the will of Richard Kellam..4 As of 1704,her married name was Sinclare.5 She married Magnis Sinclare circa 1704.5 On 7 Mar 1704/05 Edward Kellam (attorney: Mr. Washbourne) brought action for 250 lbs tobacco against Magnis Singclere, who married Sarah Kellam (widow of Richard Kellam). Because Singclere failed to appear, Kellam was granted attachment against his estate to pay the debt and the costs of the suit.5 On 4 Apr 1705 it was recorded that at the last court Edward Kellam sued Magnis Singclere (who married Sarah Kellam, widow of Richard Kellam) for 250 lbs tobacco. When Singclere failed to appear, attachment was granted against his estate. The attachment was served on a steer, and the court ordered execution to proceed to pay the debt and court costs.6 On 3 Aug 1708 Sarah Sincleare petitioned that she and her husband had put "sundry goods and chattels into ye hands of Richard Kellam for her use & relief, her husband being gone from her." When she demanded the goods, Kellam refused to deliver them to her. Since Sarah was poor and "under coverture" [under the authority of her husband], she could not commence a suit. Ordered that the sheriff summon Kellam to the next court to answer the complaint.7 On 6 Oct 1708 it was recorded that at the last court Sarah Singcleare petitioned that Richard Kellam had detained from her various goods that should be used for her support. Kellam was summoned and through his attorney (Capt. Washbourne) pleaded that Sarah, who had a husband and was therefore under coverture, could not bring any process in her name. The court agreed and dismissed her petition and ordered her to pay court costs.8 On 3 May 1710 Edward Kellam petitioned that his mother Sarah Sincleare, had "married a prophlegate man who was runn away from her," and being invited to live with William Lingo, she carried what she had to his house. Now that she had occasion to live elsewhere, Lingo refused to give back her small estate. Since Sarah had no means of support, she would have to "go upon the parish" if her goods were not returned. Kellam asked that Lingo be cited to the next court.9 On 2 Aug 1710 Edward Kellam petitioned that his mother Sarah Sincleare, had "married a prophlegate man who was runn away from her," and being invited to live with William Lingo, she carried what she had to his house. Now that she had occasion to live elsewhere, Lingo refused to give back her small estate. Since Sarah had no means of support, she would have to "go upon the parish" if her goods were not returned. Kellam asked that Lingo be cited to the next court.10 On 6 Sep 1710 William Longo was summoned to the June court to answer the complaint of William Kellam in behalf of his mother Sarah Singcleare. The matter was put to the determination of Capt. John Washbourne and Francis Wharton, who agreed that Sarah should pay Lingo 1250 lbs tobacco for 12 days worth of service of man and horse, for food and lodging for 13 months and for other small debts. After payment of the tobacco, Lingo was to deliver Sarah's goods and chattels to her. Kellam complained that Lingo would not obey the order; summoned to court to show why, Lingo had nothing to say. Sarah tried to pay the tobacco, but Lingo refused to take it. Ordered that she make tender according to law and that William Lingo deliver Sarah Kellam's goods (except for a steer that was killed) and court costs.11

Robert was born circa 1650. He married Elizabeth Lucas, daughter of Thomas Lucas, circa 1675 at England. He had been in Jamaica before coming to the Eastern Shore..1,2,3 Robert Snead was the Clerk of Court for Accomack County from 1703 to 1712. His son Charles followed him from 1712-1717.4 He married Mary (15) West, daughter of Lt. Col. John (2) West and Matilda [13] Scarburgh (Quaker), circa 1704. On 4 Oct 1706 Madam Matilda West (executrix of Col. John West, (deceased), John Wise (in the right of his wife, Matilda), Jonathan West, Richard Kellam (in right of his wife Farncis), Katherin West, Robert Snead (in right of his wife Mary), Thomas Harding (in right of his wife Scarburgh Harding) the sons and daughters of Col. John West and Matilda, petitioned that the estate be divided according to the will. Since most of the persons desired that John Custis, Exp., be appointed, it was ordered that the and col. William Custis, Lt. Col. Tully Robinson, Maj. George Parke and Capt. John Braudhurst (or any four of them) divide the estate of John West before the next court or as soon as convenient. On 6 Dec 1706 Robert Snead and his wife Mary (one of the daughters of Lt. Col. John West, deceased) exhibited a bill against Matilda West (executrix), who was summons to this court. The sheriff returned a copy of the writ (with the summons on the back) that was left at Matilda's dwelling house. When she did not appear, Snead's attorney (Mr. Andrew Hamelton) requested and was granted an attachment against "ye body of Matilda West" the sheriff was to deep her in safe custody till she posted a bond to appear at the next court. On 5 Feb 1706/7 Robert Snead and his wife Mary (daughter of Lt. Col. John West, deceased) brought an action against Matilda West (executrix of the estate), who was taken into custody on 31 Jan by Sheriff Tully Robinson to ensure her appearance at this court. Matilda refused to put her answer in writing. West had left his "four daughters viz Catherine Mary Ann & Scarburgh each a young slave in the estate. Snead and Matilda West ultimately reached an agreement. Snead would give up his right to Mary's share of cattle, Horses, sheep and household goods. Matilda would have her first choice of the six young slaves (she selected Sarah). Catherine West could have second choice (Bette). Snead would have third choice (Gui). The court ordered Matilda to immediately deliver to Gui to Snead.
.5,6 In 1705 the county prison was considered insufficient to hold a certain prisoner and the room that Robert Snead, clerk of court, used for his office was ordered used as a prison until a new one could be built. In the same year Robert Snead was one of 6 residents of the county appointed to make a contract with workman for the building of a new court house, for the old court house was thought by the court to be past repairing. The site of the new court house was close to the building in the area known as Matompkin where court had been held and was also close to the present court house in the same area, which after the Revolutionary War became known as Drummondtown and about a century later changed its name again to Accomac.2 Robert was named as the executor of a will on 17 January 1709 at Accomack Co, VA. It was on this date that Bennony West's will named brother & friend Capt. Sead to assist his wife Sarah as Extr to his will..7 Robert was named as a headright on 3 May 1709 at Accomack Co, VA. It was on this date that Robert Snead was granted a certificate for 300 acres for transporting himself, his wife Elizabeth and their 4 children Robert Jr., Frances, Charles and James..2,8 Robert bought land in 1709 at Accomack Co, VA. It was in this year that Robert Snead bought 150 acres in the vicinity of the Accomack County Court House. He also owned land along the Indian River in Maryland, which he called Snead's Purchase. The time of his arrival in Virginia isn't known, but it was probably before 1700, for in 1703 he became Clerk of Court for Accomack County, which position he held until his death in 1712, when he was followed by his son Charles as clerk..2 In April 1711 the court clerk, Robert Snead became sick and was unable to attend court. Upon Robert's petition, his son Charles Snead was sworn to officiate as the clerk till his father was able to return. A year and a half later, Robert was dead and Charles officially took over. William was born on 19 November 1677 at Nickawampus Creek, Acc Co, VA.2,3 William was named in his father's will on 5 January 1695/96 at Accomack Co, VA. He was shown as my eldest son William in the will of William Burton, wife Ann. He was given land on the seaboard side, situated in Forked Neck near where I now live.1 On 18 Feb 1695/96 William Burton (son of Mr. William Burton, deceased) had been named in the elder Burton's will as joint executor with his mother; now he "desired to relinquish that charge in open court." It was ordered recorded.4 On 2 Jun 1697 upon the motion of Jane Bird, it was ordered that William Parker, Henry Lurton, William Burton and James Lary inventory and appraise the estate of Jane's deceased husband Edward Bird. A report was to be given at the next court.5 The 2nd William Burton followed his father as Justice in Accomack County court and was on the Quit Rent Rolls of 1704 with 500 acres.2 On 6 Feb 1699/1700 so he could be entered into the list of tithables, Timothy Dunow servant boy to William Burton, was judged to be 11 years old.6 On 2 Apr 1700 three constables who had "served a great time" asked to be discharged from their positions. The court appointed Richard Hickman to replace Richard Greenall; Ralph Justice to replace John Bloxum, Sr; and William Burton to replace Edmund Allen. The new constables were ordered to go to the nearest magistrate to be sworn.7 He married Frances (-----) on 20 December 1700. She may have been Frances Bagwell.8 On 3 Jun 1701 William Burton petitioned to be discharged from his office of constable, in which he had served one year. The court appointed Mr. James Alexander constable in Burton's place.9 On 6 Oct 1708 it was ordered that William Parker, James Alexander, William Burton and William Phillips (or any three of them) inventory and appraise the estate of Thomas Tayler before the next court.10 William was named in his father-in-law's will on 14 January 1708/9 at Accomack Co, VA. He was shown as my son-in-law (meaning step-son) William Burton in the will of James Alexander, wife Ann.11 On 1 Feb 1708/09 William Burton (empowered by his mother Ann Allexander, widow and executrix) presented the will of James Alexander (deceased). It was proved by the oaths of Francis Wharton and Delight Sheild.12 On 2 Apr 1709, so they could be duly entered into the list of tithables, William Burton's two Negro girls were brought to court to have their ages judged; Hagar was judged to be 9 years old, and Moll was judged to be 7 years old.13 He served on a jury on 7 March 1709/10 at Accomack Co, VA. He was shown as Wm. Burton who served on a jury in a trespass case between Francis Thorowgood against John Mathews.14 William Burton was a justice of Accomack County in 1711 and sheriff in 1723. On 3 Jul 1711, as commissioner, Mr. William Burton subscribed to the test and took the oaths of justice of the peace and for the court of chancery.15 William was named in his mother's will on 6 September 1711 at Accomack Co, VA. He was shown as son William Burton in the will of Ann Alexander. She also named his son William Burton.16 On 6 May 1712 Ordered that certain men take the lists of tithables: Mr. Wm. Burton from the courthouse down to the end of the county on the Sea Side.17 On 6 May 1712 the action brought by Regnolds Badger against John Wylie (administrator of the estate of Thomas Taylor, deceased) had been continued from time to time. Capt. Henr. Scarburgh and Mr. Wm. Burton had been appointed to audit the accounts, but since Burton was now in Pennsylvania and Scarburgh was over the Bay they could not return the audit. The case was continued to the next court.18 On 5 Aug 1712 William Burton and Edward Robins (churchwardens and assignees of Thomas Custis, the sheriff) brought action against Jno. Millechop for the nonappearance of Catherine Brook, who had been presented at the May court for bastard-bearing. Millechop now confessed judgment and was ordered to pay 500 lbs tobacco for Catherine's fine, pay court costs and to give security to save the parish from supporting the child. On the same day William Burton, churchwarden, presented the following persons for "not abiding in ye Church during ye time of Common prayer and preaching": Morris Sheapheard, Thomas Luis, Thomas Foscue, Jonathan Bunting, William Twiford and Jonathan Chambers. John Booth and Elizabeth Hutton were presented for fornication "by Common fame." Ordered that the above persons were ordered to appear at the next court to answer their presentments. On 2 Sep 1712 At the last court Mr. William Burton (churchwarden) presented the following individuals for "not abiding at ye Church nor beheaving himselfe as he ought to during devine Servis or common prayer & preaching":
- Morris Shepheard (fined 5 shillings, or 50 lbs tobacco, plus court costs) - Jonathan Bunting (fined 5 shillings, or 50 lbs tobacco, plus court costs) - Thomas Yoskue (fined 5 shillings, or 50 lbs tobacco, plus court costs) - Thomas Lewis (not in court because of sickness; ordered to appear at the next court) - William Twiford (failed to appear; ordered taken into custody till posting a bond to appear at the next court to answer the presentment and for his contempt) - Jonathan Chambers (fined 5 shillings, or 50 lbs tobacco, plus court costs) The same churchwarden presented John Boath for "fornication by common fame with Elizabeth Huton." Boath, who was present in court, was ordered taken into the sheriff's custody till he posted a bond for his good behavior and for not cohabiting with Elizabeth Huton. Also presented for fornication, Elizabeth Huton failed to appear at this court. Ordered that the sheriff take her into custody till she posted a bond to appear at the next court.19 On 3 mar 1712/13, as stipulated in an Act of the Assembly, between the last of January and the last of March, the court presented to the Governor the names of three justices to be considered as the next sheriff for the county. This court recommended Mr. Thomas Custis, Col. Tully Robinson and Mr. William Burton.20 On 3 Nov 1714 a commission from the Lt. Governor for the swearing of justices was read. Col. William Custis, Col. Tully Robinson, Maj. George Parker, Capt. John Bradhurst, Mr. Hancock Custis, Mr. Edward Robins, Capt. Henry Scarburgh, Mr. Thomas Custis and Mr. William Burton took the oaths appointed by law and subscribed to the test.21 He bought land in 1727 at Accomack Co, VA. It was in this year that William Burton bought 100 acres called Isaac's Beach in the inlet between Ceedar Island and Feches, now joining to Feches, which is part of Whitelaw's tract A44, Parramore Island. It was not mentioned in the will of William Burton, wife Mary, but it went to son William and in 1750 he and his wife Margaret of N'hamp County sold it to Thomas Parramore.22 He married Mary (15) West, daughter of Lt. Col. John (2) West and Matilda [13] Scarburgh (Quaker), circa 1728 at Accomack Co, VA. Mary West Snead was William Burton's 2nd wife..23,24,2 William Burton II deeded land as a gift on 4 December 1728 at Accomack Co, VA. It was on this date that William Burton and his wife Mary deeded Snead Mansion House to John Snead, eldest son of Mary Burton by her former husband, Robert Snead.2,25 He made a will on 18 November 1730 at Accomack Co, VA.
