Judge James Henry

James was born in 1731 at Aberdeen, Scotland.1 James Henry studied law at the University of Edinburgh and in Philadelphia and settled in Accomack County, where he was a member of the House of Burgesses, 1772-74, of the first Virginia Convention, 1774, and of the House of Delegates, 1776-78, 1779. They later moved to "Fleet's Bay," Northumberland County, where he was a member of the Continental Congress, 1780-81, judge of the Virginia court of admiralty, 1782-88, and judge of the Virginia General Court, 1788-1800. He married Sarah (79) Scarburgh, daughter of John (30) Scarburgh and Tabitha (243) Custis, in August 1757 at Accomack Co, VA.2 Judge James Henry was named as the executor of a will on 18 November 1770 at Accomack Co, VA. It was on this date that my wife & friends John Wharton & James Henry were named Exts in the will of Thomas Bagwell, Gent., wife Sophia.3 James witnessed a will on 3 February 1771 at Accomack Co, VA. It was on this date that Nehemiah Stockly, Thomas Wheelton & James Henry witnessed the will of Thomas Matthews, wife Keziah..4 He was named in an orphan's account on 25 August 1772 at Accomack Co, VA. James Henry, guardian of Robins Kendall Mathews, presented his account for the orphan by the oath of Joseph Mathews.5 James was named as the executor of a will on 28 February 1773 at Assawoman, Acc Co, VA. It was on this date that son John Drummond and brother-in-law James Henry were named Extrs. in the will of William Drummond of Assawoman, wife Sarah..6 James died on 9 December 1804 at Northumberland Co, VA. He died at "Fleet's Bay" at the age of 73 and left a will 9 Mar 1801 - 9 Sep 1805..1

He was give the plantation where I now live & all the land not already given during his natural life & then to my grandson Robert Coleburn..6 John was named as administrator of an estate on 27 April 1757 at Accomack Co, VA. It was on this date that administration of the estate of Charles Scarburgh was granted to John Coleburn.7 He sold land in 1763 at Accomack Co, VA. It was in this year tht John Coleburn sold to Stratton burton Burton 600 acres of tract A64 between Melfa & Onley, which Burton previously had sold to him by a General Court deed. Then later in 1763 John and Catharine Coleburn were joined by Stratton and Scarburgh Burton in a sale of 100 acres to William Coleburn. For reasons not clear, he deed it back to them, but the next year it was resold to him.8 He married Catherine 'Catrin' (-----) in 1763 at Accomack Co, VA.3,8 John was named in his mother's will on 21 September 1768 at Accomack Co, VA. He was shown as a son John Coleburn in the will of Elizabeth Coleburn..9 He made a will on 24 February 1776 at Accomack Co, VA.3 John died before 26 March 1776 at Accomack Co, VA.3,10

She was shown as mother Margaret Teackle in the will of William Teackle and given the plantation where James Wise now lives and she was to sell the said plantation if she choose to pay my debts..7 Margaret sold land circa 1777 at Accomack Co, VA. In tacing the ownership of Whitelaw's tract A54 in Hack Neck south of the Scarburgh Mill at the elbow of Pungoteague Creek it was brought out that in 1768 Henry & Elizabeth Scarburgh sold 400 acres to John Watts. It was in two parts of 200 acres each and the south part was subject to a life-lease which had been made in 1757 to John & Tabitha Arlington. In 1774 John & Rebeckah Watts sold the north 200 acres to William Teackle, the son of Upshur and Margaret (Scarburgh) Teackle. In 1777 William Teackle left it to his mother Margaret Teackle as the plantation where James Wise lives and she, as a widow, sold it to Thomas Teackle. In 1784 Thomas Teackle left it to his son George Teackle, calling it the plantation purchased of Margaret Teackle on the head of Pungoteague. In 1811 George Teackle (wife Ann) left to his son St. George W. Teackle and in 1834 he sold it to William Mason..8 She made a will on 8 April 1782 at Accomack Co, VA. To be buried without a funeral sermon in the graveyard where my first husband lies. Edmund [11] Scarburgh (III) and Elizabeth Mitchell, circa 1715.1 In the 1724 will of John Fisher, who named a sister Elizabeth Floyd, he gave his brother-in-law John Melter my mare that John Potter has.2 John Potter Sr. married Mary (-----) circa 1728.3 John Potter Sr. bought land in 1728 at Northampton Co, VA. It was in this year that Jonah and Elizabeth Belote assigned 2 parts of tract N127 to John Potter, Merchant. Then in 1741 Jonah Belote and his wife Mary (relict of John Potter) released her dower rights to John Potter of Accomack and he sold the Wainhouse part to James Delpech.4 John was named as an appraiser of an estate on 15 January 1728 at Northampton Co, VA. It was on this date that administration on the estate of Richard Bull was granted to Esther Bull relict of the dec'd. Appraisers: John Potter, George Nicholas Turner, John Addison & Daniel Eshon.5 John was named as an appraiser of an estate on 8 July 1729 at Northampton Co, VA. It was on this date that administration on the estate of Mary Kellum was granted to Daniel Eshon son of the dec'd. It was in this year that John Potter bought 70 acres of the Hamerin part of tract N120 near Exmore from William Lawrence. He was a member of the Lower House of the Maryland Assembly from Baltimore County, 1663-64 and was a justice of Baltimore County, 1665-67.2 He married Henrietta Maria Neal, daughter of Capt. James Neal, circa 1665.1 He was of "Greenbury Point," Anne Arundel Co, MD. Richrard died before 6 May 1667 at Anne Arundel Co, MD.3

Elizabeth was born circa 1674 at Accomack Co, VA. She married William Parker, son of John Parker (I) (Mattapony) and Amey Anderson, circa 1690 at Accomack Co, VA.2 On 2 Jun 1703 in Acc Co Court, Mrs. Elizabeth Parker, widow of William Parker, complained that George Parker Sr., had in his custody Scarburgh Parker, the daughter of William and Elizabeth. Scarburgh's father had left her with George Parker, who now refused to deliver the child to her mother without an order of the court. Since George Parker was not present, it was ordered that the sheriff summon him to the next court. Later that same day, Mrs. Elizabeth Parker, widow of recently deceased William Parker, petitioned that William who had "departed this life in ye Province of Maryland," had left a small extate there. Elizabeth had only a few items in her possession, an inventory of which the court ordered to be recorded: a bed, bolster, rug and blanket; a pewter tumbler and a small "gold hoop ring." The list was signed on 2 Jun 1703, by Elizabeth Parker alias Scarburgh. A copy of Elizabeth's written petition followed; in it she promised payment to anyone with a just claim against the estate, "being wholly desirous to relinquish all manner of claim to any part or parcel of the said Parker's estate.2 She married George Dewey circa 1704 at Northampton Co, VA.1,3 Elizabeth was named in her father's will on 21 May 1711 at Accomack Co, VA. She was named as daughter Elizabeth and given only 1 shilling. It was noted that she having had her part of the estate of Col. Edmond Scarburgh. (It is assumed that this was Col. Edmond's younger daughter Elizabeth, as the older daughter Elizabeth, who had married Philip Parker, was probably deceased by this time.).4 Elizabeth was named in her sister's will on 30 November 1713 at Accomack Co, VA. She was named as sister Elizabeth Duey..1 Elizabeth was named in her husband's will on 7 November 1714 at Northampton Co, VA. She was shown as wife Elizabeth in the will of George Dewey.5

He was shown as George Scarborough and she was shown as Cassey West. No other information was given..1,4 Casandra was named as an heir in November 1818 at Northampton Co, VA. It was on this date that the division of John C. West’s slaves was made. George Scarburgh and Cassey his wife, John Leatherbury and Betsey his wife, Raymond Riley and Sally his wife, Henry Custis and Tabby his wife, Sukey Stott, Eliza P. C., Margaret A., Sarah H., George P., Anne R., Catherine C. and Tabitha S. Scarburgh by George Scarburgh their next friend Complainants vs Margaret West Defendant in chancery. It was ordered that John Addison, John T. Elliott and John C. Mapp divide the slaves Aaron, Betty, Hannah, Nanny, Mary, Esther, Parker, Custis and Eliza in the following manner: To George Scarburgh & ux in right of said wife, to John Leatherbury & ux in right of said wife, to Raymond Riley & ux in right of said wife, to Henry Custis & ux in right of said wife, to Sukey Stott and Margaret West each 1/7 and to Eliza P. C., Margaret A., Sarah H., George P., Anne R., Catherine C., and Tabitha S. Scarburgh 1/7 equally among them.” The final decree is in Order Book 37 page 227 and this shows that these are the slaves of John C. West.2 She was listed with her daughter in the census of 1850 at St. George Parish, Acc Co, VA.3 Casandra died on 29 April 1859 at Accomack Co, VA, at age 81.1 Her body was interred at Fairview Lawn Cem, Onancock, Acc Co, VA.1 Administration of Casandra's estate was filed on 26 December 1859 at Accomack Co, VA. It was on this date that Alfred Lofland was named to settle her estate. George Scarburgh and Mitchell W. West were securities.5

He received several of the 1/7 of 1/9 shares of the estate of Edward Ker Jr. - One as the Admr. of Edward K. Scarburgh, one in right of his wife Catherine (who was a brother of Edward K. Scarburgh), and one as guardian his 2 daughters Margaret and Jane (assumed to be the daughters of Edward K. Scarburgh, since his wife Catherine was still living)..4 He made a will on 20 March 1821 at Accomack Co, VA. To wife Catharine Coard in lieu of dower my plantation called the Vale of Shiraus in Scarburgh's Neck whereon I now reside & 6 slaves, her choice, except 4 slaves that I will dispose of in legacies to educate & support my son Samuel William Coard, Eliza E.
