He was shown as a son Charles, under 18, in the will of John Floyd, wife Mary.1 He inherited land in 1688 at Hog Island, N'hamp Co, VA. It was in this year that Mary Lloyd (Floyd) on behalf of (her sons) Charles, Berry & Matthew Lloyd (Floyd), was alloted the south end of Hog Island which had be patented to her husband John Floyd the year before and he had died.2 Although he received 1/3 of his father's land on Hog Island, he lived elsewhere in N'hamp County. He also owned land on Prout's Island, deeding part of it to William Shepheard on 28 July 1692, and devising another part in his will. He was recorded in the 1704 quitrent rolls as owning 378 acres in N'hamp County.3 He married Elizabeth (29) Fisher, daughter of John (7) Fisher (IV) and (-----) (-----), circa 1698.4 Charles was named as administrator of an estate on 28 November 1709 at Northampton Co, VA. It was on this date that administration on the estate of Georg Esdall was granted to Charles Floyd on behalf of himself and the child of the dec'd with William Nottingham, Argoll Warren securities.5 He bought land after 1710 at Cheriton, N'hamp Co, VA. In 1710 William Melling sold 100 acres to John Stockley, it being in the southeast corner of tract N36 (west of Cheriton) next to N23 and N37. In 1719 Charles Floyd (wife Elizabeth) left 100 acres to son James, being two tracts of 50 acres each bought from William Melling and John Stockley. In 1723 Melling and Stockley each gave 50 acres deeds to James Floyd, saying that they had sold to his father Charles, but had not executed deeds before his death. The Melling piece was north of Stockley and was the northeast corner of the tract. The in 1771 title had descended to another Charles Floyd and in this year 30 acres at the south side were laid off for John Floyd and Peter Warren, but title for it soon passed to James Spady. He also had acquired a part of N34 and when he died he owned a total of 56 acres in an inverted "L" shape. In 1800 a division of the Spady land, 25 acres of the Floyd part went to a son John, while the N34 part went to son James. In 1827 the balance of the Charles Floyd land north of Spady had been bought by John Knight and in a division in this year 26 acres went to a son Thomas and 34 acres to John Tyson who had married Sally Knight.6 Charles Floyd served in the House of Burgesses from 1710 to 1718.4 He made a will on 15 December 1718 at Northampton Co, VA. To my loving wife Elizabeth. To my son John the plantation whereon I now live, and my part of Pront Island, and all my clothes. To my son James 30 A. lately bought of John Stockley and the 50 A. lately bought of W(lost) Molling. (Last line on page lost.) To my son Matthew 1/2 my land on Hogg Island, and the other half to my youngest son who I intended to be (called) Samuel. To each of my daus., viz., Sarah, Mary, Hester, and Elizabeth Floyd a cow. To wife remaining personal estate during her widowhood and then to be eq. div. by wife and all my children. Wife extrx. Witt: Argoll (A) Wilkins, Mary (M) Hyran, Hannah (X) Roberts, William Waters..7,8 Charles died before 17 February 1718/19 at Northampton Co, VA. It was on this date that his will was probated..4,8 He estate was settled on 20 September 1720 at Northampton Co, VA. It was on this date that the Court approved the inventory and appraisal of the estates of both Charles and Elizabeth Floyd on the oath of their son John, since no inventory of Charles' estate had been returned during the lifetime of his executris.3

Thomas was born in 1725 at Northampton Co, VA. Thos. Fisher chose a guardian in Jul 1743, implying he was age 14 or older, bur under 21. Thos. Fisher, son of Thos and Sarah, was shown to be age 18 in Nov 1743..2 Thomas was living on 1 December 1737 at Northampton Co, VA. It was on this date that he was named as under age 21 in his step-father's, John Benson's, will. At age 21 Thomas was to get 'silver shoe buckles, negroes Toby, Rachael and Jemmy and all the carpenter's and cooper's tools that were his father's..3 He married Mary 'Polly' Bell, daughter of Thomas Bell and Mary Watson, circa 1750.4 Thomas was living on 14 August 1753 at Northampton Co, VA. It was on this date that William and Thomas Fisher were left £10 each by Thomas Edmunds when they come to lawful age. They were evidently his step-sons, the children of his wife Sarah who was the widow of Thomas Fisher who died circa 1727. The confusing part here is that he said 'when they come to lawful age' as they would have then been at least 26 years of age (1753-1727) by this time, so he could have been referring to William and Thomas Fisher, sons of his wife Sarah's son Thomas. This would have made them his step-grandsons..5 Thomas was living on 12 May 1760 at Accomack Co, VA. It was on this date that he was named as a son-in-law in Thomas Bell's will..6 Thomas was named in his mother's will on 25 October 1760 at Northampton Co, VA. Thomas Fisher Sr. was named the executor to his mother Sarah's estate..7 He made a will on 11 January 1771 at Northampton Co, VA. Thomas Fisher Sr. named a wife Mary; sons Thomas, Caleb, John, George and William. He left his wife negros Daniel, Leah, Elizabeth and Jack and gold sleeve bottons. To son Thomas negros Jacob, Toby and Lucretia; a still and worm and still tub and land on Hog Island. To son Caleb the 250 acre plantation in Accomack bought from Col. James Rule's heirs, negro boys Isaac and William and woman Sarah and gold sleeve buttons. To son John negro woman Rachel and Jeane, boy James, £200 and gold sleeve bottons marked "S:E." To son George negro girls Nanny and Grace, boy Jacob, gold sleeve bottons marked "S:E," 28 gallon copper kettle and £250. To son William negro boys Abel and Stepney, girl Adah, child Amey, gold sleeve bottons and £250. Custody and tution of son William to William Ronald until 21. The land leased from my kinsman Thomas Fisher Jr. to be sold. Residual Legatees wife and four sons Caleb, John, George and William. Wife, son Thomas and friend William Ronald executors. Witnesses John Thomas, Josiah Heath, Robert Rodgers, Hezekiah Abdeel, and William Ronald. A Codicil dated 19 Jan 1772 left son John 250 acres on Mushmilon Creek in County of Sussix. Sons George and William each 1/2 of 592 acres last bought in Sussix and 40 acres of marsh on Cedar Creek..8 Thomas died in 1772 at Northampton Co, VA.8 Thomas's will was probated on 11 February 1772 at Northampton Co, VA. In order of probate, Thomas Fisher Jr., the named executor, was heir at law (meaning he was the oldest son)..8

William Fisher (brother of Ensign John) died leaving a will, and Sally Fisher his widow and one of his legatees is dead leaving a will; William Fisher the son and one of the heirs of the said William Fisher is dead leaving a will and Polly Nottingham (formerly Polly Fisher) the daughter of William the brother of of John, died intestate (N'hamp Co Orders, 1831-36, p. 71). On 12 Mar 1833 it was ordered that - John R. Fisher, guardian of Margaret Susan Fisher; Samuel P. Fisher, guardian of William J. Nottingham and Anne W. Ewing (formerly Anne Hopkins) guardian of Susan Hopkins, or their authorized attorney, have leave to sell and assign the land bounty script to which the said Margaret Susan Fisher, William J. Nottingham and Susan Hopkins are entitled as infant heirs fo John Fisher deceased who was an Ensign in the Army of the Revolution of the Virginia Line on continental establishment (N'hamp Co Orders, 1831-36, p. 179). On 11 Nov 1851 it was ordered that - John Fisher, who was an Ensign in the Rev. War died intestate leaving George and William Fisher his only heirs at law ... (much of the earlier information was repeated, but new information included) James Fisher gave his property to Susan Hopkins, who has since died intestate leaving her mother Ann W. Ewing her only heir at law. William R. Fisher died intestate leaving William R. Fisher, Margaret Fisher (now wife of John T. Johnson), Mary W. Fisher (wife of Littleton L. Read) his only heirs at law. Samuel P. Fisher is dead leaving a will by which he gave his estate to his wife Susan B. Fisher and his sons Charles F.M. Fisher and Samuel P. Fisher, who are his only legatees. Sally Nelson died intestate, leaving Cincinatus Brickhouse her only heir at law (N'hamp Co Orders, 1851-57, p. 14). On 10 Mar 1856 it was ordered that - Miers W. Fisher is guardian of Juliet A. Fisher, who is a minor, and Nath'l. Robert Carey has married Susan Fisher; the said Juliet A. and Susan are devisees of Ann W. Ewing, dec'd, who was heir at law of Susan Hopkins, dec'd, who was a devisee of James Fisher, dec'd, who was one of the legatees and devisees of George Fisher, dec'd, who was one of the heirs at law of John Fisher who was an Ensign in the Rev. War (N'hamp Co Orders, 1851-57, p. 452). This Juliet A. Fisher and Susan Fisher were probably nieces of Ann W. Ewing, but since Ann had several other brothers in addition to Miers W. Fisher, it is not clear as to who their father was, either John R. or Edwin Fisher..1 John died in 1785 at Northampton Co, VA.2 Administration of John's estate was filed on 9 November 1785 at Northampton Co, VA. The estate of John Fisher was administered to (his brother) George Fisher on 9 Nov 1785. Appraisers were John Tompkins, John Stringer, Isaac Avery and John Carpenter (N'hamp Co Orders, 1783-87, p. 362).3

James was born in 1771 at Northampton Co, VA. Jas Fisher, orphan of Thos, chose his guardian May 1785, implying he was age 14 or older at that time..1 James was named in his father's will on 29 May 1778 at Northampton Co, VA. He married Mary 'Polly' White, daughter of William White and Rachel Jacob, on 13 December 1791 at Northampton Co, VA. George Melhollomes was the security on the M.L.B. of James Fisher and Mary White, daughter of William White, deceased..2 James was living on 28 November 1794 at Northampton Co, VA. It was on this date that he and Hancock Jacob were named to administered Rachel White's estate. She would have been his mother-in-law..3 James died in 1795.4 Administration of James's estate was filed on 13 July 1795 at Northampton Co, VA. It was on this date that his estate was administered to William Fisher (probably his uncle?), Polly the widow of James having declined. Appraisers were John Tompkins, John Elliott, Robins Mapp and Kendall Addison.5 In describing the ownership of tract N88, Whitelaw traces the John Fisher Part as follows: "1720 - The will of John Fisher mentioned no land, but being entailed it went to his eldest son Thomas. 1727 - He left everything to his wife Sarah, but the land went to his eldest son, also a Thomas. 1772 - Thomas, Jr. (wife Mary), left to his son Thomas (III) but upon his death without issue the title reverted to his mother, who married Tully R. Wise, the son of Colonel John Wise IV. 1812 - He left the property to a son of the same name, and in 1841 Tully R. and Ann K. Wise sold the plantation of 758 acres by survey to Southy S. Satchell." On closer investigation, it is evident that Whitelaw did not trace the later Fisher generations accurately, perhaps because of two wives named Mary, both nicknamed Polly, the older one a Bell and the younger one a White. He was correct up through 1772. However, Thomas (III) did not die without issue, as he had a son James whose estate was administered to a William Fisher on 13 Jul 1795, Polly the widow of James having declined. Polly was Mary White, daughter of William deceased, who had married James Fisher on 13 Dec 1791. It was this Mary Fisher who married Tully R. Wise on 7 Dec 1797 and not Thomas (III)'s mother Mary, as she died in 1785, as Polly Fisher. To further complicate matters, James Fisher may have had a son, Tully Wise Fisher, born about the time of his death, or his wife Mary had a bastard child by her future husband, Tully R. Wise. Ironically, if Tully Wise Fisher was in fact James' son, it would be he who should have inherited the land instead of Tully R. Wise obtaining it by marring the widow of James.6

William was born before 7 March 1594/95 at Ashford, Co Kent, England.1 He was in France and the Low Countires in 1616 and late in 1617 was living with his cousin Thomas Godfrey at Selling, Co Kent, England.1 He sailed for Virginia in the William and Thomas, arriving 29 Aug 1618.1 He was employed as agent by Sir Nicholas Tufton (afterwards Earl of Thanet) and was in command of Smith's Hundred Company in 1619 when he engaged in a shipboard quarrel near Newport News with Capt. Edward Roecroft alias Stallenge and, striking him with his scabarded sword, "cleft" his skull. Rosecroft died the next day. Epes, tried, was found guilty of manslaughter, but after a short while was restored to his command.1 He married Margaret (-----) before 1623.2 By 1623 he was commander of the Estern Shore. In the census, 16 Feb 1623/4, he, Mrs. Epes and "Petter Epps" are listed on the Eastern Shore. Here in 1624 William Epes accused Ensign Savage of libelling him and "did lay the said Ensign Savage neck and heels"; small wonder he was called a "mad, ranting fellow."1 By 3 May 1630 William Epes was a member of the Council of St. Christopher's. On 18 July 1633 he made a power of attorney to William Stone concerning his land in Virginia. By the later 1630's he had returned to Ashford, Co Kent, England.2 William made a will on 13 January 1640/41 at Co Kent, England. He named a wife Margaret, son William and daughter Frances. Margaret, who came to Virginia in the George, 1621, married him by 1623.2 William died before 3 March 1642/43 at Co Kent, England.2

ChartsDescendants of John Fisher (First Families of Virginia)
Patience was born circa 1674. She married Thomas (8) Fisher, son of Capt. Phillip (4) Fisher (I) and Elizabeth Maddox, circa 1690.1 Patience was living on 28 May 1709 at Northampton Co, VA. It was on this date that she was named to settle her husband Thomas Fisher's estate on behalf of her and children..2 She married Francis Wainhouse (II), son of Francis Wainhouse (I) and Margaret (-----), before 28 July 1709.3 Her mark resembles "V." Patience was a defendant in a court case in Northampton Co., VA, 1710. According to Purse & Person and Whitelaw, Patience married 1st Thomas Fisher and 2nd Francis Wainhouse. With the following information, compelling evidence is given that Patience married 3rd Thomas Marshall. In her will, probated November 8, 1765, Patience Marshall named her daughter Margaret (Wainhouse) Haggoman, a child of Francis Wainhouse named in his 1717 will. Margaret married first Joachim Michael and William Haggoman second. Sept 28, 1710, Court, Northampton Co., VA: this day the action of the case between Alexander Bagwell and Francis Wainehouse as marrying Patience Fisher executors of Thomas Fisher deceased defendant being called in July Court last and by consent of both plantiff and defendant...judgement is granted by the plantiff against the defendant for the sum of 400 pounds of tobacco to be paid out of the estate of Thomas Fisher deceased with cost of suit. (Frank V. Walczyk, Northampton Co. VA Orders & Wills 1698-1710, Vol. II, 1704-1710, Peter's Row, Coram, NY, 2001, p. 174) Thomas Marshall was named guardian to Francis and Margaret Wainhouse, for whom he filed an accounting in 1724. Accomack court records state that Thomas was made guardian for these orphans of Dorothy Wainhouse on her marriage. Dorothy was Francis Wainhouse, Sr.'s sister. She was probably the first guardian after his death and she married about 1715. The Accomack records do not say 'why' Thomas Marshall was named, but it appears he married Patience about 1718-19. Patience also named her grandson, Esme Baily, son of Edmund and Rose Bayly, in her will (although Isma Bayly was her great grandson by her granddaughter, Rose Fisher) and Thomas Marshall was Isma Bayly's guardian at the death of his father, Edmund Bayly in 1751. The administration of Thomas Fisher's estate was granted to Patience on behalf of herself and her children in 1709. Records show that Maddox Fisher was the son of Thomas Fisher; however, the names of any siblings are not provided. The use of the word "children" in the administration indicates more than one. A Tabitha Johnson, wife of John d. 1754, named her son Ismy; neither Tabitha Johnson nor Ismy Johnson were named by Patience (John predeceased and Tabitha's date of death is unknown) but there were many relations between the Marshalls and Johnsons. In addition, Patience's son, Francis Wainhouse married a Bridget Johnson. Patience named her children by Thomas Marshall in her will, including Esme Marshall, their eldest son. Based on approximate dates of birth for Maddox Fisher, Sr., the probate for Thomas Fisher's estate and marriage to Francis Wainhouse, Sr., Patience was probably ten or so years senior to Thomas Marshall. She would have married at about age 15 had children in her late 30's and lived into her 80's.4 Patience was named in her husband's will on 4 December 1717 at Northampton Co, VA. She was shown as wife, no name, in the will of Francis Wainhouse and shown as Patience Wainhouse, relict and Extrs..5 She married Thomas Marshall, son of John Marshall, circa 1718.3 Patience was named in her husband's will on 19 January 1760 at Northampton Co, VA. This was her third husband, Thomas Marshall..6 She made a will on 11 October 1765 at Northampton Co, VA. To grandson Esme Baily pari of gold sleeve buttons. To grandson Hezekiah Tinley one horse colt. To daughters Patience Allen and Margaret Haggoman all my clothes. To sons Esme Marshall and Thomas John Marshall. To Margaret Dunsemore one silk hatt. Two sons Esme and Thomas John Marshall and Thomas Fisher Sr. executors. Witnesses were Thomas Fisher Sr., John Michael, and Mary James..7 Patience died in 1768 at Northampton Co, VA.7 Patience's will was probated on 8 November 1768 at Northampton Co, VA.7
