Capt. William Whittington
M, b. circa 1616, d. before 1 January 1659/60
William was born circa 1616.1 He married Elizabeth Weston circa 1640.2 Capt. William Whittington emigrated into N'hamp Co, VA before 1647.3 Whitelaw, in discussing the ownership of A54 (pg 806-7) states that in "1654 William Whittington was made "Feoffee in trust and Guardyan to the Estate of Charles the Eldest sonne of Leiftenant Collonel Edmund Scarburgh." Among the assets at the time were "9 Hogsheads of Tobacco received for the Sale of a Tract of Land" (part of A37); nothing more was found recorded about Whittington as acting in that capacity and apparently the colonel soon took over full management of his son's affairs. Just when the event took place was not determined, but Charles married Elizabeth, the daughter of Richard Bennett who was governor of the colony during the Commonwealth administration, and she survived him." This gives further creedence to believe that Captain William Whittington's daughter, Ursula, was the first wife of Captain Edmund Scarburgh Jr., Charles' younger brother. William made a will on 4 May 1659 at Northampton Co, VA. He was shown as Capt. William Whittingtoh. Intending to take a voyage to Holland. To my son William Whittington all my land in Virginia (excepting 300 A. on a branch near where Edward Gunter and Richard Clark live, according to my patent). To the child (boy or girl) my wife goes with, all my land in the Province of Maryland. To my dau. Urselie Whittington the 300 A. (excepted as aforesaid out of my Virginia lands). To my servant Jane Beaman 2 cows. To Argoll Yeardly one mare foal. For the use of a free school in Northampton County 2000#t. Resid. legatees my beloved wife Elizabeth Whittington, my son William, my dau. Urselie, and the child my wife goes with to be eq. div., but to remain in my wife's possession until children come to age if she remains my widow. If my wife marries then my friends William Waters and John Penewell to care for my children's estates, and my wife to have no benefit of my land save only that which I bought of William Taylor where she now dwells which she is to have for life. Wife extrx. Witt: William Melling, John (J) Turner, Margaret Neale.(Notes by Jim Marshall: Elizabeth the widow of (Capt.) William Whittington married (Capt.) William Spencer, and the name of the unborn child is perhaps Elizabeth. Francis Whittington is the brother of William Garwood.2 William died before 1 January 1659/60 at Northampton Co, VA. It was on this date that his will was probated..2

He was a Justice in Accomack County. He is referred to as Edmund Scarburgh (1st) because he had a younger brother also named Edmund, who is referred to as Edmund Scarburgh (2nd). "Their father left his land, previously surveyed and laid out by him, as follows: to his eldest son Edmund 832 acres which included the home part; to his second son Edmund 604 acres which were at the mouth of Craddock Creek; and to his son Mitchell 564 acres near the head of Craddock Creek. From two later records it seems evident that it was the elder Edmund who had died, for beside the 832 acres left to him by the will of his father, there was also bequeathed to him a still, and in 1715 the widow Elizabeth made an agreement with the surviving son Edmund in which was mentioned 'the still which he had received from the estate of his brother Edmund'; also in 1725 the living Edmund made a deed of gift to his son Edmund of 832 acres 'given by Edmund Scarburgh deceased to his (i.e. the son's) Uncle Edmund." Edmund (1st) died unmarried and without issue" (Whitelaw, pp. 619-620 - tract A17). Edmund was born circa 1677 at Accomack Co, VA.2 Edmund was named in his grandmother's will on 14 June 1691 at Accomack Co, VA. He was named as grandson Edmund Scarburgh (under 12), son of Edmund Scarburgh in the will of Mary Scarburgh..3 Edmund was named in his father's will on 21 May 1711 at Accomack Co, VA. He was named as the eldest son Edmund Scarburgh and given 832 acres out of my Neck of 2,000 acres surveyed for him my me, in the will of Col. Edmund Scarburgh..4 He made a will on 1 October 1713 at Accomack Co, VA. The words of the verbal will of Edmund Scarburgh late deceased, late of this County Accomack, spoken in the hearing of the evidenced hereunder named. I do desire that what I received of my father's estate given to me by my father's last will may be equally divided between my two brothers, Scarburgh & Mittchell. By Juke Johnson and John Teackle - Sworn to before Henry Scarburgh on 1 Oct 1713. Edmund was born in 1692 at Accomack Co, VA. In a deposition of 26 Jul 1748, Edmond stated he was age 56 years and upwards, puting his birth at 1692..2 Edmund was named in his father's will on 21 May 1711 at Accomack Co, VA. He was named as the second son Edmund Scarburgh and given 604 acres out of my 2,000 acres surveyed for him my me, in the will of Col. Edmund Scarburgh..1 He married Priscilla (-----) circa 1712.3 Edmund was named in his sister's will on 30 November 1713 at Accomack Co, VA. He was named as brother Edmund Scarburgh Jr. in the will of Tabitha Bell..4 He married (-----) (-----) circa 1720.5 Edmund Scarburgh (the younger) was a justice and sheriff of Acc Co, 1720, Naval Officer of the Eastern Shore, 1726, Colonel of Militia, and left a will written 8 Nov 1753 and probated in York Co, VA. For more information on Edmund Scarburgh (the younger) see Whitelaw, pp. 620- 621. The listed children may not be from the first marriage. He married Susanna Upshur, daughter of Arthur Upshur (II) and Sarah Browne, after 3 July 1722. Susanna (Upshur) Teackle, married Edmund Scarburgh (the younger) sometime after 3 July 1722 when her deceased husband's (John Teackle) estate was administered to his widow, Susanna Teackle..6,3,7 Edmund [34] Scarburgh the younger deeded land as a gift in 1725 at Accomack Co, VA. It was in this year that Edmund Scarburgh gave the 832-acres part of tract A17 to a son Edmund, to take effect upon the death of the father, but if the son died first without issue the title was to revert to the father, which is what happened. A survery of his land in 1735 showed 1,607 acres. In 1753 the will of Edmund Scarburgh was probated in the York County Court, as he was then living there with his last wife, Anna Maria, who shortly afterwards married a John Thornton. He left his land here to a son William (Meredith) Scarburgh and also mentioned daughters Priscialla Johnson (husband Obediah) and Elizabeth Hall (husband Thomas). In 1756 his son William Scarburgh (wife Alice) left his land to a son William, but the court named another son Edmund as the heir-at-law and he seems to have inherited. The widow Alice married Isaac Dunton.8 He married Anna Maria Jones, daughter of Rev. Rowland Jones, circa 1740.3,8 On 26 Jul 1748 it was recorded in Accomack Court: Edmond Scarburgh of Accomack County Senr. aged fifty six years and upwards who being sworn and examined declares that thirty years ago and upwards he this deponent was acquainted with one George Knight a shoemaker soon after his first arrival in the Accomack County that the deponent was well acquainted with the said George who told this deponent that was born in England and that his father was named Thomas Knight and lived there and also that he had brother in law there one Bey a cabinet maker by trade and the deponent further says that the said George had sundry looking glasses and other things shipped to him to these parts at sundry times and as he told this deponent came from the said Bey his brother-in-law that this deponent bought several of the goods so shipped of the said George and in part of pay gave the said George a bill of exchange on Mr: WCicajah Pony then Merchant in London which was never returned to this deponent protested and he further declares that the said George showed this deponent a paragraph of a letter which he told him was wrote to him by the said Bey wherein he recommended to the said George to give the deponent the first ofter of the goods at that time shipped to him as he had been a good customer that the deponent knew the said George after he married and lived in Northampton and that Thomas Knight now present is the now only son as this deponent has been informed and believes to be true of the said George born in wedlock and further saith not. Signed: Edmond Scarburgh (NOTE: Matilda Riggs, wife of John Riggs, was also a deponent and was evidently Edmond's sister.).2

It is not positive that this Captain Richard Bayly Jr. is the same as the Richard Bayly II referred to in Whitelaw, who was a descendant of Richard Bayly I (est. 1600-1661). There are many references to the name Richard Bayly in Whitelaw. A quick search of Whitelaw indicates that Richard Bayly I (1600-1661) came to Virginia via the Barbadoes in 1640 and married Elizabeth, widow of Henry Weede who died in 1644. They moved from the Henry Weede property (N88) to a part of A18 on the south side of Craddock Creek next to A17, which was Colonel Edmund Scarburgh's property. The was the area were Colonel Edmund's son, Edmund Jr., and Edmund Jr.'s daughter Ursula resided. Therefore, it would seem most likely that the Richard Bayly Jr. that Ursula married would have been Richard Bayly II. Richard Bayly II (est. 1645-1728) was married in 1665 to Mary Jones, sister of a Henry Jones and daughter of Mary Harper. He later married Elizabeth, who survived him. He had at least two sons. One was Richard Bayly III, wife Rosana, who had three sons: Edmund Bayly (? -1796), Richard (?-1769) wife Betty, and Henry (?-?). Richard Bayly II's other son was Edmund, to whom he gave 800 acres of land in 1694. The explanation could be that Richard Bayly II married Ursula Scarburgh after Mary Jones and before his last wife Elizabeth. Edmund could have been the son of Ursula and Richard, as it was a Scarburgh family name. [Whitelaw pg 460, 635-9, 642, 846, 892, 898, 1051] His common name was Richard. Richard was born circa 1665 at Accomack Co, VA.2 He married Rosanna (-----) circa 1688. There were named in the will of Richard Bayly in 1726 when he left to grandson Henry Bayly, son Richard and Rosana Bayly dec'd, 250 acres on the north side of Craduck Creek..1 He married Ursula [30] Scarburgh Jr., daughter of Col. Edmund [11] Scarburgh (III) and Ursula Whittington, before 1693 at Accomack Co, VA.3 He made a will on 15 November 1707 at Accomack Co, VA. To son Henry Bayly 200 acres in Somerset County, Maryland at the head of Pitts Creek. To daughter Lacey Bayly. To sons Richard, Edmund, Henry & Whittington Bayly. Daughters Ursilia Whittington & Joyce Bayly. Eldest son Richard. Wife Ursilia & son Richard Extrs. Children under 18. Father, brother Edmund Bayly, & friend Joseph Milby overseers.
