His will of 3 Dec 1708, codicil of 20 Mar 1711/2 and probated 16 Mar 1713/4 named his wife Sarah, sons John, to whom he left Arlington House, Hancock and Henry, daughters Elizabeth Custis and Sorrowful Margaret Kendall, wife of William Kendall, and Yeardley Michael (son of John Michael's 3rd wife), and the codicil mentioned grandson Custis Kendall..2 His body was interred at Wilsonia Neck, N'hamp Co, VA. His tombstone, erected by his widow, records that he was colonel and commander in chief of the militia of the Eastern Shore, that he died 26 Jan 1713/4 in his 60th year, that he first married Margaret, daughter of Mr. John Michaell, by whom he had 7 sons (3 of whom were buried near him) and 2 daughters, and that his 2nd wife was Sarah, daughter of Col. Southey Littleton and widow of Mr. Adam Michael. A later inscription adds that Sarah died 18 Apr 1720 in her 51st year..4
