     Henry was born circa 1700 at Accomack Co, VA. He was the son of Maj. Richard Bayly (II) and Elizabeth Lacy?. Henry was named in his father's will on 19 April 1726 at Accomack Co, VA. There are two different Henry Bayly's named in the will of Richard Bayly. One is clearly a grandson Henry Bayly, son of Richard & Rosana Bayly, dec'd, who was given 250 acres on the north side of Craduck Creek & for want of heirs to grandson Southy Bayly. The other one is named in the list for the balance of the estate, which is to be divided in 6 parts between (1) wife Elizabeth, (2) Richard Bayly, (3) Henry Bayly, (4) Whittington Bayly, (5) Lacy Harman and (6) Henry Bayly the son of Richard & Rosanna. The (3) Henry Bayly is assumed to be a son of Richard Bayly, the testator..3 Henry was named in a land cause on 28 December 1742 at Accomack Co, VA. There are also clearly 2 different Henry Baley's named in this land cause. The first is of course the grandson Henry Baley, son of Richard Baley and Rosanna dec'd. However it notes that soon after grandson Henry Baley takes possession of the land, he afterwards died without issue and the land descended to Southy Baley, who after the death of the said Henry on 1 Mar 1728 (1729 new calander), by Henry Baley his guardian, took possession of the land and ever since hath received use of the land. The Henry Bayly, guardian of Southy Baley, is clearly not the grandson Henry who died on 1 Mar 1728. The assumption is that the guardian Henry Baley is a son of Richard who devised the land and an Uncle of Southy. (Note: Since this land cause was recorded on 28 Dec 1742, it is assumed that both Southy and his guardian Henry Baley were still living in 1742.).4 Henry sold land in 1750 at Accomack Co, VA. Whitelaw states that in 1750 Henry Bayly sold the land that have been given to grandson Henry Bayly to Thomas Jacob, but as the land had been entailed it was recoverd by his brother Richard Bayly, who in 1753 sold 200 acres to Thomas Jacob. Whitelaw failed to study the land cause carefully and missed the fact that grandson Henry had died and the land passed to grandson Southy, under the care of his guardian Henry Bayly. It would have been the guardian Henry Bayly who tried to sell the land to Thomas Jacob in 1750, but since Southy had evidently died by this time, the land reverted back to the surviving grandson Richard Bayly..5
